Parents and Youth Activists Demand Action on Congress Kids Web Safety Law

WASHINGTON D.C. (AP) — A resolute coalition of parents and impassioned youth activists is intensifying their campaign to compel Congress to implement crucial legislation aimed at enhancing web safety for children. They argue that the continued delay in enacting these reforms could gravely imperil the well-being of countless youngsters.

In a spirited move, these advocates are preparing to descend upon Capitol Hill this coming Tuesday, fervently demanding the passage of S.1409, aptly known as the Kids Online Safety Act. This fervent appeal has been orchestrated by Fairplay, a children's advocacy and tech accountability group. The bill, which garnered approval from the U.S. Senate Commerce Committee in July, has since been caught in a legislative stalemate, chiefly due to concerns raised by internet law experts and First Amendment proponents. Their primary apprehension is that the proposal could, in their estimation, unconstitutionally muzzle anonymous speech and potentially obstruct minors' access to essential information.

Furthermore, supporters of the legislation are preparing to deliver a poignant letter to congressional leadership, one that will bear the heartfelt signatures of numerous parents who've tragically lost their children due to the proliferation of perilous social media challenges, unrelenting cyberbullying, and accidental drug overdoses, stemming from substances purchased through social media platforms.

Maurine Molak, a devoted parent activist who lost her son David to cyberbullying, fervently states, "Congressional action is long overdue. The members of Congress have been presented with irrefutable evidence and scientific backing, unequivocally affirming the urgent need for the Kids Online Safety Act. It is categorically unacceptable for grieving parents who've steadfastly advocated for KOSA over the past year to witness more children succumb to the perils of social media. Inaction is no longer an option; Congress must act decisively."

The forthcoming advocacy event is transpiring precisely one year after the initial visit to Capitol Hill by these dedicated activists, who passionately implored Congress to institute substantive reforms. These reforms are intended to transfer responsibility for the regulation and operation of social media platforms from families to the corporations that own them, thereby ensuring a safer online environment for children.

The Vision of KOSA

The Kids Online Safety Act (KOSA) aims to actualize this vision by instituting a duty of care on social media platforms. This responsibility would compel them to proactively prevent and mitigate severe harm to minors, encompassing mental health consequences and cyberbullying. It mandates that these platforms undergo independent audits, subjecting their practices to public scrutiny by experts and academic researchers.

Additionally, the bill obligates platforms to default to the most protective settings, combat addictive design strategies that prolong children's online engagement, and proactively address and rectify reports from distressed children and parents.

Urgent Plea from Parents

A heartfelt letter from the parents resounds with urgency: "American families need the Kids Online Safety Act now; we cannot delay any longer. Every day that social media remains unregulated, more children fall victim to its perils."

Since their inaugural visit to Capitol Hill, these determined activists have engaged with numerous lawmakers, rallying support for KOSA, culminating in 47 co-sponsors. However, the bill continues to face steadfast opposition from entities like Fight for the Future and TechFreedom, a libertarian think tank. These opponents argue that KOSA could potentially jeopardize minors' access to critical information and encroach upon their right to free speech.

"The Kids Online Safety Act is the vital legislation required to cultivate a healthier, happier, and safer internet for young people," stated Josh Golin, the Executive Director of Fairplay. "It should not be the burden of grieving parents to convince Congress of KOSA's dire necessity."

Parents Share Their Stories

Among the parents poised to visit Washington on Tuesday is Kristin Bride, whose 16-year-old son, Carson, tragically took his own life in 2020 after enduring relentless bullying on now-defunct anonymous messaging apps, LMK and Yolo. Bride, in solidarity with Fairplay, recently implored the Federal Trade Commission to scrutinize the marketing and user engagement practices of another anonymous messaging app, NGL. The activists assert that NGL, launched in 2021, is beset by content moderation and safety issues and should not be directed at vulnerable minors.

Kristin Bride passionately emphasized, "Over the past decade, anonymous apps have consistently incubated teen cyberbullying, often culminating in suicides. The fact that NGL has discovered a way to profit from this suffering is deplorable and merits immediate attention from the Federal Trade Commission."

In a compelling and heartfelt effort, these unwavering parents and passionate youth activists continue their fervent fight for web safety reform, their mission undeterred by opposition as they seek to protect the nation's most vulnerable users.
