The U.S. Chamber of Commerce has voiced concerns about the transparency of certain policy decisions after obtaining documents under the Freedom of Information Act (FOIA) that suggest Biden trade officials maintain a "deferential and highly coordinated approach" with Sen. Elizabeth Warren, D-Mass.

In a statement on Tuesday, the Chamber revealed that its FOIA requests, submitted in December, aimed to uncover the motivations behind the Office of the U.S. Trade Representative's (USTR) abrupt withdrawal of support for robust digital trade rules at the World Trade Organization (WTO). The Chamber has previously contended that this move jeopardizes growth and innovation for U.S. companies.

The documents received this year, the latest of which were turned over last month, show numerous "heads up" emails from the USTR to Warren's office, providing advance notice before public announcements. They also document extensive email exchanges between the senator's office and the USTR to "manage the fallout" following the WTO digital trade decision, according to the Chamber.

"The issue that we have tried to bring transparency to is the decision-making process inside USTR and the one-sided nature in which that decision process was driven, against the wishes of the broader Congress and against the wishes of others in the administration," Sean Heather, the Chamber's senior vice president for international regulatory affairs and antitrust, told Law360. "The question is, what is in the U.S. national interest?"

The Chamber's Tuesday statement highlighted that the USTR's "close coordination with Senator Warren's office raises serious questions about transparency and influence." The organization noted the selectively deferential approach and early communication on significant decisions impacting digital trade rules and other trade-related matters.

A spokesperson from the USTR criticized the Chamber's interpretation of the documents, stating, "The Chamber, through its ongoing cherry-picked FOIA campaign, once again shows that it believes only those who share its views should be given time and attention by USTR."

In addition to digital trade issues, the documents provide insight into communications between Warren's office and the USTR regarding investor-state arbitration. One notable example is a May 2023 letter from U.S. Trade Representative Katherine Tai to Warren and U.S. Rep. Lloyd Doggett, D-Texas, responding to their earlier request for support in the Honduran government's fight against a U.S.-based developer's multibillion-dollar claim.

Tai's letter stated, "President Biden does not believe corporations should receive special tribunals in trade agreements that are not available to other organizations, and he opposes the ability of private corporations to attack labor, health, and environmental policies through [investor-state dispute settlement]. I share these views, and the United States is not currently pursuing any trade or investment agreements that would establish ISDS." She added that her office is "closely tracking" the case but did not indicate any further action plans.

The documents also include several email exchanges between Warren's office, the USTR, and the U.S. Department of State arranging meetings to discuss the investor-state arbitration issue.

This revelation underscores the Chamber's ongoing concerns about the transparency and decision-making processes within the USTR, particularly regarding the influence of key political figures like Sen. Warren on critical trade policies.
