A proposed class of buyers has filed a $50 million lawsuit against Glenmark Pharmaceuticals Inc., alleging that the company's extended-release potassium chloride capsules are dangerously defective. The lawsuit, filed in New Jersey federal court, claims that the capsules release potassium too quickly, resulting in the death of the lead plaintiff’s mother.

The suit was initiated by Debra Butler, whose mother, Mary Louise Cormier, died after taking the allegedly defective pills. According to the complaint, Glenmark’s capsules, although marketed as compliant with United States Pharmacopeia (USP) standards, functioned like rapid-release capsules, posing serious health risks. The lawsuit accuses Glenmark of knowingly selling these defective products, prioritizing profits over patient safety.

Glenmark $50M Suit : Allegations of Rapid Potassium Release

The lawsuit contends that Glenmark’s extended-release potassium chloride capsules, which are commonly prescribed to treat hypokalemia, failed to meet the essential USP guidelines. These guidelines are designed to prevent the rapid release of potassium, which can cause dangerous spikes in blood potassium levels and lead to cardiac arrest. Butler’s complaint starkly states that Glenmark’s capsules were "more suitable for an execution" than medical treatment.

According to the complaint, Cormier experienced severe symptoms, including lethargy and minimal responsiveness, after taking Glenmark’s pills. When she was taken to MaineHealth Maine Medical Center’s emergency department, blood tests revealed alarmingly high potassium levels, so extreme that the medical staff ordered retests to confirm their accuracy. Tragically, Cormier was transferred to hospice care and died shortly thereafter.

Glenmark $50M Suit : Recall and Alleged Negligence

The complaint points to a Class I recall of 46 million of Glenmark's potassium chloride capsules that began on May 30, 2024. A Class I recall is the FDA’s most serious type, issued when there is a reasonable probability that the use of a product will cause severe adverse health consequences or death. However, Butler alleges that Glenmark waited an additional month before warning patients, by which time her mother had already taken the pills that led to her death in June.

Butler asserts that her mother’s death could have been avoided if Glenmark had not sold the defective drugs or had promptly alerted patients to the risks. The lawsuit also raises concerns about other batches of the potassium chloride pills, noting that they are under a Class II recall, and highlights Glenmark’s history of pulling products from the market due to contamination issues.

Seeking Justice and Accountability

Butler seeks to represent a class of all U.S. residents who purchased Glenmark's potassium chloride pills, arguing that the capsules are worthless due to their dangerous nature. The lawsuit seeks full refunds for these buyers, along with damages for any injuries caused by the pills.

The complaint includes claims of fraud, strict liability, and violations of the New Jersey Consumer Fraud Act. Butler is represented by Aaron Block and Max Marks of The Block Firm LLC, and Roshan D. Shaw of Anderson & Shaw LLC. Glenmark’s legal representatives have not yet been disclosed.
