Eleventh Circuit Vacates David Rivera $456K Fine

The Eleventh Circuit has vacated a judgment and $456,000 fine against former U.S. congressman David Rivera, who was accused by the Federal Election Commission (FEC) of violating campaign finance laws. The appeals court determined that the lower court had improperly discounted Rivera's competing testimony, leading to its decision to remand the case for further proceedings. This development in the "David Rivera $456K Fine" case marks a pivotal moment in the ongoing legal saga.

David Rivera $456K Fine : Appeals Court Finds Lower Court's Error

The appeals court's decision to vacate the $456,000 fine and send the case back to the lower court was reached after a request for rehearing by Rivera was denied earlier in the week. Rivera had argued that the federal court lacked jurisdiction and that the FEC did not comply with pre-suit notice requirements.

In July, the Eleventh Circuit concluded that the district court had erred in granting summary judgment for the FEC, as genuine issues of material fact still existed and should have been presented to a jury. The lower court relied on grand jury testimony, a plea colloquy from one of Rivera's associates, and testimony from independent witnesses, while improperly discounting Rivera's deposition testimony and two sworn affidavits.

"We find the denials in the deposition and affidavits significant," the Eleventh Circuit noted in its opinion. "The district court's ruling, considering this evidence, runs contrary to the instructions provided by Rule 56, which state that summary judgment may only be granted where there is no genuine dispute as to any material fact."

Jurisdictional Arguments and FEC Procedures

Rivera reiterated his arguments that the federal court did not have jurisdiction in the matter because Congress only authorizes courts to intervene in Federal Election Campaign Act enforcement cases that the FEC is unable to resolve after attempting conciliation. According to Rivera, the FEC did not follow mandatory pre-suit procedures, including notifying Rivera's attorney of its probable cause finding and providing a proposed conciliation agreement. This procedural oversight, Rivera argued, undermined the FEC's ability to bring the case to court.

Background of the Campaign Finance Allegations

The FEC's complaint accused Rivera of secretly funneling approximately $76,000 in contributions to the campaign of Democratic primary candidate Justin Lamar Sternad during the 2011-2012 election cycle. The allegations arose after campaign finance reports from Sternad failed to disclose the true source of the funds, which the FEC claimed were channeled through vendors at Rivera's direction.

The FEC asserted that Rivera’s financial support was intended to help defeat Joe Garcia, his primary Democratic rival for the 26th Congressional District in Florida, thereby boosting Rivera's chances of winning the seat. Despite these efforts, Garcia ultimately won the election.

Sternad faced criminal charges and pleaded guilty to making a false statement, illegal campaign contributions, and conspiracy to defraud the U.S. He was sentenced to seven months in federal prison, which was later reduced to 30 days. Sternad's political consultant also pleaded guilty to related charges in 2014.

Disputed Testimony and Reports

The allegations against Rivera also included claims that he funded vendors to produce and distribute campaign materials for Sternad and directed a political consultant to misreport payments as loans from Sternad's campaign. Rivera’s counsel contested these facts, arguing that the campaign finance reports were amended to correctly identify the source of the funds. Rivera's legal representation maintained that the district court erred by dismissing his affidavits and testimony, which created a genuine dispute that should have prevented summary judgment.

The panel of U.S. Circuit Judges overseeing the appeal included Judges Robert J. Luck, Charles R. Wilson, and Barbara Lagoa. Rivera is represented by Thomas L. Hunker and Virginia A. Paxton of Hunker Paxton Appeals & Trials, along with Jeffrey D. Feldman of Jeffrey D. Feldman PA. Representing the FEC are Shaina Ward, Lisa J. Stevenson, Greg J. Mueller, Jason Hamilton, and Kevin Deeley.

With the Eleventh Circuit vacating the fine and remanding the case, the legal battle is far from over. The case will now return to the lower court for reconsideration, where Rivera will have the opportunity to present his testimony fully, and any remaining disputed facts can be put before a jury.
