President-elect Donald Trump announced Monday that he will impose significant tariffs on imports from Canada, Mexico, and China immediately after taking office, reigniting his aggressive trade policies from his first term. The measures, revealed in a post on Truth Social, are aimed at combating illegal immigration, drug trafficking, and what Trump alleges are unfair trade practices by these nations.

Trump pledged to sign executive documents on Inauguration Day, Jan. 20, imposing 25% tariffs on all imports from Canada and Mexico and an additional 10% tariff on Chinese goods, on top of the duties already in place.

Trump Tariff Vow : Tariffs Tied to Border and Drug Policies

Trump linked the Canadian and Mexican tariffs to what he called "an invasion" of illegal immigrants and drugs, including fentanyl.

"As everyone is aware, thousands of people are pouring through Mexico and Canada, bringing Crime and Drugs at levels never seen before," Trump wrote. "This Tariff will remain in effect until such time as Drugs, in particular Fentanyl, and all Illegal Aliens stop this Invasion of our Country."

In the case of China, Trump accused the nation of failing to fulfill promises to curb the export of illicit drugs to the U.S. He declared the 10% tariff would remain until China demonstrated compliance.

Legal Routes for Implementation

It remains unclear how Trump plans to enforce these tariffs, but several legal mechanisms are available, each with differing levels of scrutiny.

• International Emergency Economic Powers Act (IEEPA): This law allows the president to impose tariffs unilaterally in response to a national emergency. Trump previously invoked similar authority to pressure Mexico during his first term.
• Section 301 of the Trade Act: Frequently used during Trump’s initial presidency, this provision allows for tariffs to counteract unfair trade practices, such as those alleged against China.
• Section 232 of the Trade Expansion Act: This authority permits tariffs based on national security concerns and was used for steel and aluminum duties during Trump’s earlier administration.

Trump’s proposals come with potential legal challenges, especially as his previous tariff actions often tested the limits of executive power.

Building on Existing Trade Policies

The 10% tariff on Chinese goods is significantly lower than the 60% rate Trump floated during his campaign but extends existing duties ranging from 7.5% to 25% initiated in his first term. Notably, President Joe Biden has upheld many of these Trump-era tariffs and even expanded them in critical industries like semiconductors, solar cells, and electric vehicles.

In April, Biden hinted at further tariff increases on Chinese imports, citing unfair trade practices. Trump’s latest move reflects a continuation of this bipartisan focus on trade imbalances with China.

Commerce Leadership and Economic Impact

Trump’s announcement comes just days after naming Wall Street financier Howard Lutnick to lead the Department of Commerce. Lutnick, a key figure in the president-elect’s trade agenda, is expected to oversee tariffs and collaborate with the Office of the United States Trade Representative.

"He will lead our tariff and trade agenda," Trump said on Nov. 19, signaling a tough stance on trade policy.

The proposed tariffs also risk escalating tensions with China, already a focal point of global trade conflicts.
