Fauci invokes Fifth Amendment at Senate Covid-19 Hearing

Rand Paul isn't letting this one go quietly. The senator says Anthony Fauci should brace for fallout after the former Covid czar invoked his Fifth Amendment right against self-incrimination rather than answer questions before Paul's committee Wednesday — a move that turned what was billed as testimony into something closer to a legal standoff.

"It's against the law to obstruct an investigation of Congress. There will be repercussions for your refusal to testify," Paul told Fauci, the longtime government health official who steered the nation's pandemic response. Paul has already scheduled a vote for Aug. 5 within his Homeland Security and Governmental Affairs Committee on a resolution that would formally declare Fauci in contempt of Congress.

A Pardon That Changes Everything

Why the Fifth Amendment Card Isn't So Simple Here

Normally, invoking the Fifth Amendment — the constitutional shield against self-incriminating statements — is a fairly airtight way to sidestep uncomfortable questions at a hearing without facing blowback. But Fauci's situation carries an unusual wrinkle: President Joe Biden pardoned him for all official conduct spanning 2014 through 2025, effectively closing the door on federal criminal prosecution for many of the very pandemic decisions Paul was hoping to press him on.

Republicans argue that pardon undercuts Fauci's ability to claim fear of prosecution for anything covered within that window. Even so, Fauci isn't entirely in the clear — state or local prosecutors could theoretically still pursue charges, and federal prosecutors could act if Fauci were found to have lied under oath to the committee. Fauci, for his part, said he believed Paul's real goal was baiting him into a misstep that could trigger a perjury accusation.

The Contempt Powers Congress Could Wield

Adding another layer of complexity is Congress's own arsenal for dealing with uncooperative witnesses. The Senate could pursue civil contempt sanctions, asking a court to order Fauci to testify — a path that could ultimately expose him to fines or even jail time if he continued to refuse. In theory, the Senate could even direct its sergeant-at-arms to physically detain Fauci under its rarely used "inherent contempt" power, though that authority hasn't been exercised in nearly a century, making it more historical curiosity than realistic threat.

There's also the option of criminal contempt, where the Senate votes to hand the matter over to the Justice Department for possible prosecution. That path isn't purely theoretical — former Trump aides Peter Navarro and Steve Bannon were both convicted of contempt misdemeanors after refusing to testify before the Jan. 6 committee, each ultimately serving four months behind bars. Their situations differed from Fauci's in one key way, though: both cited executive privilege rather than the Fifth Amendment, and neither showed up for depositions at all.

A Lawyer Removed From the Room

Tensions boiled over further when David Schertler, Fauci's attorney, tried to interject after Paul warned of consequences, arguing that the Constitution should protect his client from exactly this kind of pressure. Paul wasn't having it — security escorted Schertler out of the hearing room entirely.

"It was outrageous for Sen. Paul to exclude his counsel for counsel making a legitimate legal point," Schertler said afterward in a statement, framing the moment as proof of something deeper. "It proves the baseless and vindictive nature of this proceeding and Rand Paul's personal vendetta against Dr. Fauci."

A Legal Tightrope for the 85-Year-Old

One particularly precarious risk facing Fauci, 85, is this: if a court eventually rejects his Fifth Amendment claim, he likely won't be able to fall back on the argument that he was simply following his attorneys' advice. The D.C. Circuit Court of Appeals settled that question back in 1961, ruling that the so-called advice-of-counsel defense doesn't apply to those accused of willfully defying Congress.

Some judges in more recent rulings have voiced skepticism about the reasoning behind that decades-old precedent, but the appeals court has so far declined to revisit it — leaving that legal door firmly shut for now.

Fauci Digs In as Accusations Fly

At the hearing, Paul accused Fauci of masking Covid's true origins — Paul has long argued the virus escaped from a Chinese lab that received U.S. research funding — and of pushing unnecessary school and church closures during the pandemic. Fauci, in response, repeatedly declined to engage with the questions at all.

"On the advice of counsel, I respectfully decline to answer based upon my rights under the Fifth Amendment to the Constitution," he said, repeating the phrase like a shield raised again and again against incoming blows.

Fauci's Counterpunch

In his opening statement, Fauci didn't hold back either, accusing Paul of orchestrating a setup designed to trap him. He pointed to what he called Paul's "obvious obsession with calling for my prosecution, his repeated slanderous comments about me, and recently his publicly releasing my unredacted personal diary aimed at embarrassing and intimidating me" — a rebuttal that framed the hearing itself as retaliation rather than oversight.

Paul, undeterred, said he intends to explore "appropriate actions" to keep pressure on Fauci moving forward.

Part of a Larger Pattern on Capitol Hill

Fauci's move is far from unprecedented in Washington's current political climate. Dozens of witnesses across recent high-profile congressional investigations have leaned on the Fifth Amendment to avoid testifying — from Joe Biden's own physician to a long list of figures summoned by the House's Jan. 6 select committee. In nearly every case, those assertions effectively neutralized efforts to compel testimony, since resolving such disputes through litigation would likely drag on for months or even years — time these committees simply didn't have.
