Pope Leo XIV stepped directly into one of Europe’s most difficult legal and moral debates on Sunday, condemning medically assisted dying during a visit to Lourdes just weeks after France enacted a new statutory right to assisted dying.

Speaking September 27 at the Accueil Notre-Dame center for sick and disabled pilgrims, Leo said human dignity cannot depend upon illness, disability or legislation. He warned against causing death under the guise of “false compassion” and added a line that cuts straight to the legal issue, “What is legal is not necessarily moral.” Vatican

France is no longer debating merely whether assisted dying should become law. It is law. President Emmanuel Macron promulgated Law No. 2026-794 on August 18 after the National Assembly gave the measure final approval July 15. The legislative history was anything but routine. The Senate repeatedly rejected the assisted-dying measure, including on July 7, before the National Assembly exercised its ability under France’s legislative process to adopt the text definitively on July 15. Sénat

The resulting law is considerably more specific than the phrase “legalized euthanasia” might suggest.

To qualify, a person must be at least 18, be a French citizen or stable legal resident, suffer from a serious and incurable condition threatening life in an advanced or terminal phase, experience treatment-resistant or unbearable suffering related to that condition, and retain the ability to express a free and informed decision. A physician must evaluate the request through a collegial procedure within a maximum of 15 days. If the legal criteria are satisfied, the patient must confirm the request following a minimum two-day reflection period and may withdraw at any time. Healthcare professionals also receive a statutory conscience protection permitting them to refuse participation. info.gouv.fr

One provision deserves particular attention because it explains why the law goes beyond conventional notions of physician-assisted suicide. Ordinarily, the qualifying patient administers the lethal substance personally. But if physically unable to do so, the law permits administration by a physician or nurse. info.gouv.fr

Leo’s criticism therefore presents a direct conflict between two very different concepts of autonomy. French lawmakers created a legal mechanism allowing a competent, terminally or gravely ill adult to decide when certain statutory conditions are met. Catholic teaching takes the opposite moral position—that human dignity remains inherent even in severe suffering and that intentionally causing death cannot become legitimate merely because the state authorizes it. There is also an important procedural point easily lost in headlines saying assisted dying is now “legal” in France. Although the statute has been enacted, the French government says implementing decrees are still required before the system can be put fully into practice. info.gouv.fr

That makes Leo’s intervention unusually timely. France has moved beyond an abstract debate over whether assisted dying should be legalized. The harder questions now concern how the state will administer it, how doctors will determine eligibility, how vulnerable patients will be protected, and where the boundary between individual autonomy and medical responsibility will ultimately be drawn.
