AG Nessel Sues Blue Cross Blue Shield Over Alleged Michigan Insurance Monopoly

Michigan Attorney General Dana Nessel has taken aim at one of the state’s most powerful health insurers, filing a federal lawsuit accusing Blue Cross Blue Shield of Michigan of illegally building and maintaining a health insurance monopoly.

The AG Nessel sues Blue Cross Blue Shield case was filed Thursday in the U.S. District Court for the Eastern District of Michigan. Nessel’s office is seeking civil penalties, restitution and other financial relief the court deems appropriate, along with rulings that the insurer violated the federal Sherman Act and Michigan’s Antitrust Reform Act.

At the center of the lawsuit is a market share so large, Nessel argues, that it has squeezed competition and left Michigan businesses, families and health care providers facing the consequences.

Blue Cross Controls Major Share of Michigan Market

According to the attorney general, Blue Cross Blue Shield of Michigan controls approximately 65% of Michigan’s health insurance market and 79% of the state’s PPO insurance plans.

Nessel’s office alleges that this dominance was not simply the result of winning customers in a competitive marketplace. Instead, prosecutors say it grew through a series of agreements involving the broader Blue Cross Blue Shield network.

The agreements allegedly divided customers and territories, limited the insurance products available to consumers and weakened competition for health insurance services.

The attorney general argues that the alleged conduct has helped push health care costs higher for both companies and individual consumers.

Providers Feel the Pressure

Nessel’s office also claims the impact extends beyond insurance premiums and into doctors’ offices and hospitals.

According to the attorney general, medical professionals have been forced to scale back services, replace clinical employees with administrative workers or leave Michigan altogether.

Her office pointed to the closure of Sturgis Hospital in St. Joseph County, near the Michigan-Indiana border, as one example. The rural hospital shut down in June, citing inadequate reimbursement for rural health care services.

The lawsuit paints the situation as a chain reaction: pressure on insurers can ripple into providers, and pressure on providers can eventually reach patients.

Rising Costs Leave Michigan Families With Fewer Choices

The attorney general’s office cited several statistics to illustrate the financial strain facing Michigan residents.

More than 40% of Michigan small-business owners reportedly say increasing health care costs have become a financial burden. Meanwhile, more than 68% of Michigan adults surveyed in 2025 said they had skipped or delayed medical care at least once because of potential costs.

Michigan also ranks 20th nationally in the number of people with medical debt in collections, according to information cited by Nessel’s office.

The lawsuit further argues that employment-based health insurance can leave families with little practical choice when selecting an insurer. If an employer chooses a particular provider, workers generally cannot simply shop for another plan on their own.

Premium increases have added another layer of pressure. The lawsuit says premiums for individual plan members climbed 23% to 24% for 2026, while premiums in the small-group market rose 11.2%.

Michigan Medicine Dispute Adds to Tensions

The litigation also points to a major contract dispute between Michigan Medicine and Blue Cross Blue Shield of Michigan earlier this year.

The two sides reached a tentative agreement in late May, only weeks before the expiration of their previous contract. The negotiations centered on which care would remain considered “in network,” a designation that can make a major difference in patients’ out-of-pocket costs.

That dispute now appears in the broader legal battle over the insurer’s role in Michigan’s health care system.

Blue Cross Says It Was “Blindsided”

Blue Cross Blue Shield of Michigan pushed back sharply after news of the lawsuit emerged.

The company said it was “blindsided” by Nessel’s announcement and stated that it had not yet been formally served with the lawsuit. Because of that, the insurer said it could not comment on the merits of the case.

But the company made its position on Nessel’s characterization of the market unmistakably clear.

Blue Cross said it “fundamentally” disagrees with the attorney general’s description of Michigan’s insurance market as uncompetitive.

“Competition exists everywhere in our state’s insurance markets, with strong local and national insurers competing with us every day,” the company said.

Blue Cross also emphasized its long-standing presence in Michigan, saying it has provided health insurance coverage in every county in the state for nearly 90 years.

The lawsuit now places that decades-long footprint under the microscope, with the court ultimately expected to determine whether the insurer’s market dominance reflects legitimate competition — or, as Nessel alleges, an illegal strategy that shut competitors out.
