Alaska Senate Election Erupts Into Legal Battle Over Rejected Ballots As Peltola Demands Answers

Three Critical Issues Behind Alaska's Ballot Dispute

  • Democrat Mary Peltola leads Republican Sen. Dan Sullivan by roughly 600 votes, with thousands of ballots awaiting review.
  • Peltola's campaign wants records identifying rejected absentee ballots before Alaska certifies its election results.
  • Alaska does not provide a general absentee-ballot error correction process, raising questions about whether voters can protect their ballots before rejection becomes final.

ANCHORAGE, Alaska — A razor-thin U.S. Senate race has triggered an emergency court fight over something most voters probably assume they have a right to know: whether their ballot was rejected, and why.

Democrat Mary Peltola's campaign filed suit Friday, November 6, against Alaska election officials, demanding immediate access to records identifying rejected absentee ballots and the reasons behind those decisions.

Peltola held a lead of approximately 600 votes over Republican incumbent Sen. Dan Sullivan when the lawsuit was filed, according to Reuters.

But the dispute reaches beyond who wins this Senate seat. It raises a serious question about election transparency: What happens when information that could reveal an improperly rejected ballot remains unavailable until after the election is certified?

The lawsuit, filed in Anchorage Superior Court by Alaskans for Mary, names the Alaska Division of Elections, Lt. Gov. Nancy Dahlstrom, and Elections Director Carol Beecher.

According to the court complaint, the campaign originally requested absentee-ballot records on October 27, before Election Day, and renewed its demand November 4.

The campaign wants records identifying affected voters, together with codes explaining why their absentee ballots were rejected. It also seeks a temporary restraining order and preliminary injunction requiring immediate disclosure.

Alaska officials disagree.

The state's Department of Law maintains that preliminary ballot-review information has historically been treated as confidential. Officials argue that releasing records while ballots are still being examined could burden election workers, expose information subject to change, and interfere with timely counting.

There is a meaningful distinction, however, between protecting an election's integrity and preventing outside scrutiny of decisions that determine which votes count.

Alaska's own election procedures expose a particularly troubling timing problem.

According to the Alaska Division of Elections, voters whose absentee or questioned ballots are rejected may not receive official notification until as late as 60 days after certification.

By then, the election will already have been decided.

And there is another complication.

Alaska historically has not provided voters with a general opportunity to correct missing signatures or other deficiencies after submitting absentee ballots.

Lawmakers attempted to change that in 2026, adopting legislation that would have allowed voters to correct certain ballot-envelope mistakes. Republican Gov. Mike Dunleavy vetoed the measure, and lawmakers failed to override his veto.

That distinction matters enormously. The issue isn't simply whether campaigns can help voters correct mistakes. Under existing procedures, voters generally cannot cure those deficiencies after submission.

Instead, timely access to rejected-ballot records could allow campaigns to investigate whether election officials mistakenly disqualified otherwise valid votes — and potentially challenge those determinations through lawful procedures.

The public-records dispute also contains an apparent contradiction worth examining.

Alaska permits authorized observers to monitor aspects of absentee-ballot review, yet officials resist providing copies of the underlying records. Peltola's lawyers argue that observing decisions without being allowed to retain documentation prevents meaningful verification.

Still, the lawsuit has not established that election officials improperly rejected ballots. Nor does it prove that the disputed records would alter the election outcome.

The calendar makes this legal battle especially consequential.

Alaska's official election schedule establishes November 13 as the deadline for receiving eligible domestic mailed ballots and November 18 for overseas ballots. The state must also complete its regional absentee-ballot review by November 18.

That leaves a narrow period for identifying potential errors before the final results are determined.

For the court, the immediate question is whether Alaska's public-records laws require disclosure of preliminary ballot decisions despite the state's confidentiality arguments.

For voters, the question is considerably simpler.

If the government rejects a lawful vote, should the affected voter have to wait until after the election to learn what happened?
