A federal appeals court has breathed new life into a high-profile civil-rights lawsuit brought by comedians Eric André and Clayton English, finding their complaint plausibly alleges that Clayton County’s airport “interdiction” stops violated the Fourth Amendment. In a 44-page opinion filed August 15, 2025, the Eleventh Circuit reversed the dismissal of their Fourth Amendment claims against the county and sent the case back to the trial court. Eleventh Circuit Court of Appeals

Why this matters now

The decision is a significant marker on what counts as “consensual” police encounters in one of the most constrained spaces in American travel—the airplane jet bridge. The court described a county practice of stopping passengers after boarding passes were scanned, holding IDs and tickets, and questioning travelers about drugs—conduct that, taken as alleged, could amount to unreasonable seizures without reasonable suspicion. Eleventh Circuit Court of Appeals

The road to appeal

André (star of The Eric André Show) and English say officers from Clayton County’s Airport Interdiction Unit stopped them on jet bridges at Hartsfield-Jackson Atlanta International Airport and interrogated them without any individualized suspicion. They filed suit in October 2022. A district judge dismissed the case in September 2023, ruling the encounters were voluntary. The comedians appealed in January 2024.

What the Eleventh Circuit actually held

Writing for a panel that included Judges Jill Pryor, Elizabeth L. Branch, and Hull, Judge Branch concluded the complaint plausibly alleges that the jet-bridge encounters were seizures—and that, as alleged, they were unreasonable under the Fourth Amendment because officers lacked reasonable suspicion. The panel sent the Fourth Amendment claims against Clayton County forward under Monell, emphasizing the allegations describe a county program that “directs the county’s officers to violate passengers’ Fourth Amendment rights.” Eleventh Circuit Court of Appeals

At the same time, the panel affirmed dismissal of Equal Protection claims and claims against individual officers, holding plaintiffs had not plausibly alleged that any specific officer acted with discriminatory purpose (a requirement for Equal Protection liability) and that the officers were entitled to qualified immunity.

The numbers behind the challenge

Counsel’s records—obtained via open-records requests—report 402 jet-bridge stops over eight months. For the 378 stops with recorded race, 56% involved Black passengers, compared with 8% of domestic travelers at the airport. Plaintiffs’ appellate brief and a subsequent statement by the NYU Policing Project peg the odds of that pattern happening randomly at less than one in one hundred trillion. What comes next

The case returns to the Northern District of Georgia, where André and English can pursue discovery on the Fourth Amendment Monell theory against Clayton County. Expect depositions and document requests on training, policies, and weekly stop logs the complaint says officers kept. Broader implications for policing and travel

This ruling underscores a persistent constitutional line: in high-security environments, “consent” isn’t consent if a reasonable traveler wouldn’t feel free to decline. As Barry Friedman of NYU Law’s Policing Project put it, “you may not be seized or searched unless you truly voluntarily consent or the government has at least reasonable suspicion.” The Policing Project

For airport policing nationwide, the opinion offers a cautionary blueprint. Programs branding their stops as “random” or “consensual” must still pass Fourth Amendment muster; municipal exposure can remain even when individual officers are immunized. That split—Monell liability for the county, qualified immunity for officers—could incentivize agencies to rethink jet-bridge and gate-area tactics, training, and documentation.

The appeal drew support from the NAACP Legal Defense Fund, the Cato Institute, current and former law-enforcement officials, and entertainers including Tyler Perry, Jamie Foxx, Taraji P. Henson, and others—reflecting both civil-liberties and public-safety concerns about coercive interdiction models.
