Apple Loses Bid For $5M

In a twist of perplexing legal developments, a California federal judge has delivered a stunning blow to tech giant Apple, denying its bid for approximately $5 million in attorney fees and expert expenses. This surprising decision comes on the heels of Apple's recent triumph in a patent infringement lawsuit filed by headphone manufacturer Taction Technology Inc.

Judge's Ruling Shatters Apple's Expectations

U.S. District Judge Todd Robinson's decision, handed down on Tuesday, shattered Apple's expectations, as he denied the tech titan's motion for attorney fees. Apple's argument revolved around Taction's alleged "unreasonable" litigation tactics, which they claimed had caused them substantial financial burdens.

Despite emerging victorious in the patent infringement battle, Judge Robinson delivered a perplexing verdict: "the fact that Taction's claims did not survive summary judgment does not mean that its claims were objectively baseless or that this case was an exceptional one."

"The claims for patent infringement in this action were reasonable," the judge added. "Accordingly, considering the totality of the circumstances, the court declines to find the case to be exceptional."

Apple's August Motion and Taction's Protracted Battle

Apple had submitted a motion in August, claiming that Taction had unnecessarily protracted the litigation by failing to admit its inability to maintain its patent infringement claims following a September 2022 claim construction order. Apple had sought a staggering $4.5 million in attorney fees and an additional $444,000 in expert expenses.

The saga reached its climax in August when Judge Robinson sided with Apple. He discarded what he deemed "improper" testimony from Taction's expert witness, Iowa State University mechanical engineering professor James Oliver. Oliver's opinions, the judge held, constituted a "new theory of infringement" that Taction had not previously presented. Without this testimony, Taction's case crumbled.

Apple Loses Bid For $5M : The Origins of the Legal Battle

The legal battle had its origins in 2021 when Taction filed a lawsuit accusing Apple of infringing on two patents related to haptics, the technology that enables electronic devices to provide tactile feedback. This feedback might be experienced, for instance, as vibrations when a call or message is received.

Taction claimed its founder, James Biggs, had pioneered technology to reduce unwanted vibrations in headphones, thus enhancing haptic feedback. The company alleged that Apple's haptic feature, known as Taptic Engine, infringed on their patents.

Apple countered Taction's claims by asserting that the Taptic Engine provided distinct vibrations, enabling users to distinguish between an alarm and an incoming call without needing to look at their device.

Apple had previously challenged Taction's patents at the Patent Trial and Appeal Board (PTAB). However, the PTAB declined to review them last year, holding that Apple had not demonstrated their likely invalidity.

Apple Loses Bid For $5M : Apple and Taction Stay Silent

Representatives for Apple remained tight-lipped, declining to comment on this unexpected turn of events. Likewise, counsel for Taction chose not to comment, leaving the legal community and tech enthusiasts in a state of anticipation.

The disputed patents are U.S. Patent Nos. 10,820,117 and 10,659,885.
