Aubrey O’Day Says Keefe D’s Tupac Murder Conviction Should Put Diddy Allegations Back Under Scrutiny

THE LEGAL RECORD

  1. Keefe D was convicted without being accused of firing the fatal shots.
  2. O’Day says accountability should extend to anyone who financed or ordered the killing.
  3. Sean “Diddy” Combs has not been charged and categorically denies involvement.

Aubrey O’Day is demanding that investigators follow the evidence surrounding Tupac Shakur’s murder wherever it leads—even if that path points toward her former Bad Boy Records boss, Sean “Diddy” Combs.

O’Day issued the pointed statement after a Las Vegas jury convicted Duane “Keefe D” Davis of first-degree murder with a deadly weapon in Shakur’s 1996 killing. The August 31 verdict marked the first murder conviction arising from one of the most infamous unsolved crimes in music history.

“Today’s verdict makes one thing painfully clear: you do not have to be the person who pulls the trigger to be held responsible for a murder,” O’Day wrote.

Prosecutors never claimed Davis fired the fatal rounds. Instead, they persuaded jurors that he supplied the weapon and orchestrated a retaliatory attack after Shakur and members of his entourage assaulted Davis’ nephew, Orlando Anderson, inside the MGM Grand.

Jurors deliberated for approximately three hours following an 11-day trial. Davis is scheduled to be sentenced on October 13 and has indicated that he intends to appeal. The conviction ended nearly three decades without a guilty verdict in Shakur’s death.

O’Day Raises the Unanswered Diddy Question

O’Day used the verdict to raise a larger—and legally explosive—question.

“If evidence establishes that anyone else financed, ordered, encouraged, or knowingly set that murder in motion, why should their accountability be any different?” she asked.

Her argument tracks the basic structure of Nevada accomplice-liability law. Under Nevada Revised Statutes § 195.020, a person who counsels, encourages, hires, commands, induces or otherwise procures another person to commit a crime may be prosecuted as a principal.

That legal principle explains how Davis could be convicted even though prosecutors did not identify him as the gunman. It does not, however, establish that Combs participated in Shakur’s murder.

During a 2008 police interview, Davis claimed that Combs had offered $1 million to kill Shakur and Death Row Records co-founder Marion “Suge” Knight. Retired LAPD detective Greg Kading testified about that interview, and portions of Davis’ recorded statements were presented during the trial.

Davis also claimed that he expected payment after the shooting and sent Eric “Von Zip” Martin to collect it.

But prosecutors presented no publicly disclosed evidence proving that Combs transferred money, communicated a murder order or participated in planning the Las Vegas attack. Davis later retreated from his earlier account and said he did not believe Combs was involved.

Allegations Remain Uncharged and Disputed

The distinction is decisive. Davis’ conviction does not constitute a judicial finding against Combs, who has never been charged in connection with Shakur’s murder.

Combs’ representatives have categorically rejected the allegations, stating that he “had absolutely nothing to do with the Tupac murder” and neither fired the weapon nor arranged the killing.

O’Day nevertheless urged the public to examine Sean Combs: The Reckoning, the Netflix documentary containing allegations about Combs’ career, conduct and relationships within the music industry.

“Justice cannot stop with the person in the car,” O’Day wrote. “It has to follow the evidence wherever—and to whomever—it leads.”

Her statement does not supply the corroborating evidence prosecutors would need to bring another murder case. But it places a long-standing allegation back under public scrutiny at the precise moment a jury has demonstrated that physical distance from a trigger does not necessarily create legal distance from a killing.

Nearly 30 years after Shakur’s death, the first conviction has closed one chapter. O’Day is arguing that investigators should not assume it closes the entire book.
