The legal saga began when Monster Energy successfully argued that Bang's "Super Creatine" claims were misleading to consumers, resulting in a massive $293 million judgment against Owoc and his company.

    The financial blow proved fatal for Bang Energy. The company filed for Chapter 11 bankruptcy in October 2022, leading to Owoc's removal as CEO. Monster Energy subsequently acquired Bang's assets in July 2023, effectively absorbing its former competitor. However, the legal consequences for Owoc personally have continued to mount.

    The $100 Million Bankruptcy Lawsuit

    The most significant ongoing legal challenge facing Owoc stems from the Bang Energy bankruptcy proceedings. The liquidating trust for VPX and Bang Energy has filed a lawsuit in the U.S. Bankruptcy Court for the Southern District of Florida, seeking over $100 million from Owoc, his wife Megan, and son Jon.

    The lawsuit paints a damning picture of corporate mismanagement and alleged fraudulent transfers. According to court documents, Owoc is accused of using company funds for personal expenses, including financing his son's real estate business, purchasing a private island, funding home renovations, and paying personal taxes. These allegations suggest a pattern of treating corporate assets as personal funds, potentially violating fiduciary duties to shareholders and creditors.

    Monster Energy has taken an active stance in opposing Owoc's attempts to dismiss the bankruptcy claims. The company has stated that the personal judgment against Owoc remains outstanding and is not affected by Monster's acquisition of Bang's assets, ensuring that Owoc cannot escape personal liability through the corporate bankruptcy process.

    Circuit Court Victory Reinforces Monster's Position

    The legal landscape became even more challenging for Owoc in April 2025 when the Ninth US Circuit Court of Appeals upheld Monster Energy's victory in the false advertising case. The appeals court's decision reinforced the original trial court's findings regarding Bang Energy's misleading "Super Creatine" marketing claims.

    This appellate victory strengthens Monster's position and validates the substantial damages awarded in the case. The $293 million judgment, which has been reported as high as $311 million after appeals processes, represents one of the largest false advertising verdicts in the energy drink industry.

    Additional Financial Pressures

    Beyond the corporate litigation, Owoc faces personal financial challenges. In June 2024, a lender filed a $30 million foreclosure lawsuit against Jack Owoc and his wife, alleging they defaulted on their mortgage for a waterfront mansion in Fort Lauderdale. This separate legal issue highlights the broader financial difficulties facing the entrepreneur as he navigates multiple legal fronts.

    AI Energy Drink Launch Amid Legal Turmoil

    Despite the mounting legal pressures, Owoc has moved forward with his latest business venture: AI Energy Drink. The product launch represents a strategic pivot, attempting to capitalize on the current artificial intelligence trend while distancing itself from the Bang Energy brand that became synonymous with legal troubles.

    The new product features Cognizin® Citicoline, a clinically studied brain health nutrient that supports focus, memory, and attention. Owoc has positioned the drink as designed to "deliver a powerful and positive uplifting, vibrant, and energizing effect using ingredients that work in concert to improve motivation and mood."

    According to Owoc's marketing materials, AI Energy is formulated to increase four critical neurotransmitters: dopamine, epinephrine, norepinephrine, and acetylcholine. These compounds allegedly play key roles in muscle activation, learning, and memory, promising to improve brain and body energy beyond traditional caffeine-based products.

    Industry Skepticism and Regulatory Considerations

    The launch of AI Energy Drink has raised eyebrows within the industry, particularly given Owoc's history with regulatory challenges. The previous false advertising lawsuit centered on unsubstantiated health claims, and industry observers are watching closely to see whether similar issues might arise with the new product.

    Karen E.
