Benson Enterprises Inc., an operator of automotive dealerships that includes Ingram Park Chrysler Jeep Dodge Ram in San Antonio, Texas, has agreed to pay $430,000 and provide additional relief to resolve a federal lawsuit alleging sex-based workplace harassment and retaliation, the U.S. Equal Employment Opportunity Commission announced.

The case centers on allegations that a male manager subjected a female fleet service adviser to repeated sexist remarks, undermined her business opportunities and contributed to a hostile workplace before she was fired after reporting the alleged misconduct.

The agreement brings the Benson Enterprises $430K sex discrimination settlement into focus as a reminder of the legal protections employees have against workplace discrimination and retaliation for speaking out.

EEOC Alleges Pattern of Sex-Based Harassment

According to the EEOC’s lawsuit, the alleged misconduct occurred between January and June 2021 at Ingram Park Chrysler Jeep Dodge Ram.

During that period, a male manager allegedly created and maintained a hostile work environment by repeatedly making offensive comments about the female fleet service adviser and women more broadly. The remarks reportedly included assertions that women were ignorant, lazy or unqualified to work as service advisers.

The allegations extended beyond verbal harassment. The EEOC claimed that the manager directed customers away from the woman and shut her out of important communications related to dealership operations.

Those actions allegedly reduced her sales and negatively affected her commission-based earnings, tying the claimed discriminatory treatment directly to her compensation.

Employee Excluded From Bonus Opportunities

The lawsuit also alleged that the manager excluded the fleet service adviser and another female employee from a workplace group chat used to announce competitions offering cash bonuses.

By leaving the two women out of those communications, the manager allegedly denied them opportunities to compete for additional earnings because of their sex.

The claims describe a workplace where access to customers, business information and financial incentives allegedly differed along gender lines, affecting both professional opportunities and potential income.

Dealership Employee Allegedly Fired After Complaints

The EEOC further alleged that the fleet service adviser reported the manager’s discriminatory conduct to the dealership on multiple occasions.

Instead of addressing the complaints, the lawsuit claimed, the dealership terminated her employment on June 11, 2021. The agency alleged that the firing was motivated by both her sex and retaliation for raising concerns about the manager’s behavior.

The allegations place the termination at the center of the retaliation claim, which concerns whether an employer punished an employee for opposing conduct prohibited by federal law.

Title VII at the Center of the Case

The EEOC brought the lawsuit under Title VII of the Civil Rights Act of 1964, which prohibits sex-based harassment and discrimination in employment conditions and protects workers from retaliation for reporting or opposing unlawful workplace practices.

The law covers discriminatory treatment that can affect an employee’s working environment, access to opportunities and terms of compensation. It also prohibits employers from retaliating against workers for asserting their rights under the statute.

Under the announced agreement, Benson Enterprises will pay $430,000 and furnish additional relief to resolve the EEOC’s lawsuit over the alleged conduct at the San Antonio dealership.

The case highlights how workplace discrimination allegations can extend beyond offensive remarks, reaching customer relationships, internal communications, bonus eligibility and employment decisions. It also underscores the separate legal significance of retaliation claims when employees report alleged discrimination.

The allegations described in the lawsuit concern conduct attributed to the manager and dealership; the settlement resolves the EEOC litigation.
