A new wave of corporate-backed spending in Texas judicial races has significantly impacted the state's intermediate appellate courts, with a major influx of funding driving the election of right-wing judges. The spending, led by a $2 million donation from billionaire Elon Musk, has brought nearly $18 million into the Judicial Fairness Political Action Committee (PAC), which helped push Republican candidates to victory in contested races.

The involvement of billionaires and major corporations in judicial races, traditionally underfunded and marked by low voter awareness, has raised concerns about the influence of corporate interests in the judicial system. The spending helped Republican candidates unseat numerous Democratic judges and win key contested positions.

In addition to Musk's contribution, other notable donors included Kenneth Fisher of Fisher Investments, Ross Perot Jr.'s Hillwood Development Co., casino giant Las Vegas Sands Corp., and TRT Holdings Inc. Each donated $1 million. These contributions have sparked debates about the growing role of corporate interests in judicial elections.

The Judicial Fairness PAC's stated goal was to elect judges who would be tough on crime and interpret the Constitution strictly. However, experts suggest that the donations may be more about promoting business interests than ideological motivations. Cal Jillson, political science professor at Southern Methodist University, explained that the surge in political spending by corporations could be a reflection of their growing influence in the state's judiciary.

While business interests have long played a role in judicial elections, the increased spending in intermediate appellate courts signals a shift. Joshua Blank, director of research for the Texas Politics Project, pointed out that such substantial spending likely goes beyond securing favorable rulings for businesses and reflects deeper ideological motivations.

The PAC’s influence was independent of the judges’ campaigns, with no direct donations made to candidates. PAC President Lee Parsley argued that the new judiciary would help restore fairness and efficiency to the state's courts, particularly by addressing what he called "erosion" in trial courts and the influence of personal injury lawyers.

Musk also made a $1 million donation to another PAC, Texans for Lawsuit Reform, which shares similar goals of shaping Texas's legal system. Critics, however, warn that the heavy influence of money in judicial elections risks undermining public trust and fairness in the justice system. Jon Taylor, a political science expert at the University of Texas at San Antonio, emphasized the issue of "buying justice" and the impact of corporate spending in elections.

In cities like Corpus Christi, Republican candidates in intermediate appellate courts won by substantial margins. However, in areas like Dallas, the races were much closer, with Republican candidates like Justin Jay "J.J." Koch securing a narrow victory for the Fifth Court of Appeals. These results reflect broader trends of Republican victories in the state, particularly following the 2016 election of Donald Trump, which spurred an increase in Democratic voter turnout.

The GOP’s success in these races was facilitated by the Texas Legislature’s decision to abolish straight-ticket voting, which once allowed voters to select all candidates from one party with a single mark. This change forced voters to consider judicial races more closely, benefiting Republican candidates, who have successfully mobilized their base. Donna García Davidson, an attorney and former judicial candidate, suggested that while the influx of money played a role in promoting law-and-order messages, it was ultimately the focus on crime and public safety that resonated with voters.

As corporate spending in Texas judicial races continues to rise, experts warn that it could further tilt the courts toward special interests, raising concerns about the long-term effects on the fairness and integrity of the judicial system.
