ChudTheBuilder’s Day of Reckoning: $1.25M Bond, Multiple Felonies, And A Live-Streamer Staring Down Decades

CLARKSVILLE, Tenn. — The camera was always rolling. But nobody expected it to end like this.

Dalton Eatherly — the brash, confrontational online personality known to hundreds of thousands as "ChudTheBuilder"— sat in a Montgomery County courtroom on May 13 as Judge H. Reid Poland III announced a $1.25 million bond. In that instant, the footage reveals everything: his countenance slumbered, his head dropped, his eyes closed — and stayed closed. Long. Heavy. Still. That wasn't performance. That was a man absorbing the full, crushing weight of what his choices had cost him. The unspoken question echoed louder than anything in that courtroom: Was it really worth it?

THE FULL CHARGE SHEET — AND WHAT IT COSTS

Eatherly faces far more than attempted first-degree murder. According to court records, the complete felony stack includes:

  • Attempted First-Degree Murder— Class A Felony: 15 to 60 years
  • Aggravated Assault— Class C Felony: 3 to 15 years per count
  • Reckless Endangerment with a Deadly Weapon— Class E Felony: 1 to 6 years
  • Employing a Firearm During Commission of a Dangerous Felony— Class C Felony: mandatory 10 years, consecutive, zero parole eligibility under TCA §39-17-1324

Stacked and consecutive, Eatherly is looking at a sentence that could functionally consume the rest of his productive life.

TENNESSEE SELF-DEFENSE LAW: A FIGHTING CHANCE — WITH SHARP LIMITS

Tennessee Code Annotated §39-11-611 is a genuine Stand Your Ground statute. Under subsection (b)(1), a person has no duty to retreat and may use deadly force if they reasonably believe it is necessary to prevent imminent death or serious bodily injury. Eatherly's defense will anchor here: Fox allegedly threw the first punch. That punch is the legal linchpin.

But Tennessee courts apply a proportionality standard that doesn't bend easily. In State v. Renner and State v. Ivy, courts held that the degree of force must align with the degree of threat perceived. A fist, under most circumstances, does not automatically authorize a firearm response — unless the defender had reasonable grounds to believe that punch could inflict serious bodily injury or death.

Under §39-11-611(e), if Eatherly's verbal conduct constituted initial provocation that invited Fox's punch, a jury could find he forfeited his self-defense rights. That's a landmine his attorneys must defuse early.

STICKS, STONES, AND THE PROPORTIONALITY PROBLEM

Here's the uncomfortable truth: Fox should have walked away. Whatever Eatherly said — however inflammatory, provocative, or cruel — no words justify throwing a punch. That old "Sticks and stones" analogy isn't just childhood wisdom; it's the controlling legal principle in every assault jurisdiction in this country. Fox's decision to make physical contact was legally reckless and arguably criminal.

But Eatherly's response is where the self-defense argument gets legally treacherous. Tennessee's reasonableness standard, applied in State v. Bult, asks whether a reasonable person in Eatherly's position would have believed lethal force was necessary — not just justified, but necessary. One punch, in broad daylight, outside a courthouse, surrounded by people? Prosecutors will argue that retreat was possible. They will argue the threat was not lethal. They will argue Eatherly escalated a manageable confrontation into a near-fatal shooting. The jury will decide whose story they believe. But this case is far closer than Eatherly's supporters may realize.

THE TIME, THE PRISON, AND THE HARD REALITY

If convicted on attempted first-degree murder alone, Eatherly faces 15 to 60 years in the Tennessee Department of Correction. With the firearm enhancement — mandatory and consecutive — the floor rises sharply. He could be in his sixties or older before he walks free.

New Tennessee state inmates are received and classified at the Turney Center Industrial Complex in Only, Wayne County — TDOC's primary reception facility. Tennessee's general prison population runs approximately 45% Black, 50% white, varying by unit. For a man whose public persona generated controversy across racial and ideological lines, the social dynamics inside a facility like Turney Center would demand a different kind of intelligence than anything a livestream ever required.

WHAT’S COMING NEXT FOR CHUDTHEBUILDER

In the weeks ahead, Eatherly's attorneys will challenge the bond amount, file motions to introduce the self-defense framework, and fight for access to all surveillance footage. If Eatherly cannot raise approximately $125,000 for a bondsman — the standard 10% — he builds his defense from a jail cell.

Expect a probable cause hearing, a preliminary hearing in General Sessions Court, and a cascade of pre-trial motions before any jury is ever seated. This legal battle will be long, expensive, and brutally public.

The camera was always rolling, Dalton. Now the whole world is watching — and the ending is no longer yours to write.
