Braden Peters, the 20-year-old internet personality better known as “Clavicular,” now faces three criminal charges in Massachusetts — rape, administering a substance for sexual intercourse, and procuring alcohol for a person under 21.

One fact should not get lost in the headlines: current reporting does not show that Peters was arrested or taken into custody in connection with these new Massachusetts charges.

According to the Associated Press, a clerk-magistrate found probable cause on September 4, and a criminal complaint was issued September 8. Peters is not in custody and is scheduled to be arraigned October 14 in Orleans District Court.

That distinction matters.

Being charged is not being convicted; and a criminal complaint is only the beginning of the process. Charges can later be amended, reduced or dismissed, resolved through plea negotiations, or ultimately taken to trial. Nothing about the filing itself establishes Peters’ guilt.

The allegations concern an encounter on May 23, 2025. According to court records and a police report, a then-17-year-old girl alleged that Peters supplied her alcohol at his family’s Cape Cod home before the alleged assault. Peters has denied the allegations.

The same alleged Cape Cod encounter had already surfaced in a civil lawsuit filed in Miami-Dade County by Aleksandra Vasilevna Mendoza, known online as Alorah or Alorah Ziva. Her lawsuit alleges battery, intentional infliction of emotional distress, fraud and unauthorized publication of her name and likeness. NBC South Florida reported that Mendoza also alleges Peters later injected her with a fat-dissolving substance without her consent during a livestream. Peters, through counsel, has denied the civil allegations.

And this is where another part of the story begins — insurance.

A criminal prosecution ordinarily is not something a homeowners, umbrella or general liability policy exists to defend. A civil damages lawsuit is different. If Peters qualifies as an insured under an applicable homeowners, umbrella, commercial or creator-related liability policy, the civil complaint could trigger a coverage review and potentially a request that an insurer provide a defense.

Whether an insurer would actually owe that defense is another question entirely.

Massachusetts law recognizes that an insurer's duty to defend can be broader than its eventual duty to pay a judgment. In Metropolitan Property and Casualty Insurance Co. v. Morrison, the Massachusetts Supreme Judicial Court explained that a defense obligation can arise where the allegations reasonably sketch a potentially covered claim. The court also recognized the effectiveness of policy language excluding injuries resulting from conduct that was both intentional and criminal.

That is the potential insurance collision here.

Civil claims alleging battery and other intentional misconduct may run directly into intentional-act, criminal-act, or abuse-related exclusions. If conduct arose from paid livestreaming or Peters’ influencer business, commercial or business-activity exclusions could also become relevant.

None of that can be determined from the allegations alone. Coverage would depend on the actual policy language, who qualifies as an insured, what claims are pleaded, what facts are ultimately established, and which state's law governs any coverage dispute.

There is presently no public indication that any insurer has accepted or denied coverage for Peters.
