Colorado Excessive Client Fees

In a legal saga filled with twists and turns, a Colorado employment attorney, Kelli Riley, the proprietor of Riley Law LLC, faced public sanction following allegations of attempting to charge a former client with excessive fees. This perplexing case unfolded as the state's Office of Attorney Regulation Counsel dug deep to uncover the shocking details.

Colorado Excessive Client Fees  : The Client-Attorney Agreement

The controversy centers on an agreement formed in 2020 when the client sought Riley's legal counsel to pursue an employment law case. Under a contingency fee arrangement, Riley was slated to receive 35% of the litigation proceeds, contingent on the case's outcome. The agreement had a clause that obligated the client to cover Riley's fees and expenses if the case were prematurely terminated.

Remarkably, these fees were strictly capped at what Riley would have earned under the contingency arrangement. Strikingly, the agreement contained no provisions for late fees or interest, making it a clear and unambiguous contract.

A Startling Twist of Events

However, the plot thickens. Several months before the case was set for mediation, Riley shockingly withdrew from the case, surprising her client. What followed left the client in a state of perplexity. Riley presented her client with an astounding invoice of $28,747, the entire amount billed during the course of their collaboration.

Adding to the complexity of the situation, Riley sent not one, but two additional invoices to the client, astonishingly bearing late payment fees. Even more perplexing, these fees were accompanied by an astronomical interest rate of 18%. It was a series of unexpected twists that left the client in shock and disbelief.

A Bold Move and Legal Repercussions

In a turn of events that seemed more like a courtroom drama, the client, whose identity remains undisclosed, decided to seek new legal representation. With the help of new counsel, they secured a settlement amounting to $25,000, a significant drop from their original expectations. Riley, however, did not back down. She audaciously attempted to enforce a lien on the settlement, claiming the initial $28,747 as owed.

Colorado Excessive Client Fees : Judgment Day

It was the Office of Attorney Regulation Counsel that ultimately stepped in, unraveling the complex web of events. They concluded that Riley's actions constituted a violation of Colorado's professional conduct rules, which expressly prohibit lawyers from imposing excessive fees on their clients.

At the time of this report, Kelli Riley had not responded to a request for comment, leaving the legal community and readers in suspense about her side of the story.

Counsel information for the parties involved remained shrouded in mystery, adding another layer of intrigue to this case.

Colorado Excessive Client Fees  : In Conclusion

This baffling tale of excessive client fees, intricate agreements, and legal consequences serves as a stark reminder of the critical role played by attorney regulations in safeguarding the rights of clients. The case, officially titled "People v. Kelli R. Riley," bears case number 23PDJ055 and is currently before the Supreme Court of Colorado.
