OpenAI and Microsoft are entangled in multiple copyright infringement lawsuits. They are centered around allegations that their large language models (LLMs) were trained on content from various publications and books without the proper permissions.

The high-profile cases against AI training claim that the artists were not compensated for the use of their content.

 One notable lawsuit, brought by The New York Times last year, demands accountability for "billions of dollars in statutory and actual damages."

 OpenAI responded by requesting that the court dismiss the claims, arguing that the Times exploited a ChatGPT glitch that caused the AI to repeat its articles verbatim.

Copyright Infringement Lawsuits

In a separate case, Judge Colleen McMahon of New York's federal court dismissed a copyright lawsuit filed by news sites Raw Story and AlterNet. 

The suit alleged that OpenAI removed identifying information—such as author names, titles, and metadata—while using their content to train its AI.

 The publications argued that this action violated the Digital Millennium Copyright Act (DMCA) by stripping away essential "copyright management information." 

However, McMahon ruled that the plaintiffs failed to demonstrate "a cognizable injury," and noted that the chance of ChatGPT producing verbatim content from their articles was “remote.”

Plaintiffs Plan to Fight On

Despite the ruling, Raw Story and AlterNet are not giving up. Attorney Matt Topic, representing the plaintiffs, expressed confidence in addressing the court's concerns with an amended complaint. He emphasized that OpenAI's practices might mislead users, as the chatbot’s responses could unintentionally convey copyrighted information.

Financial Stakes

Beyond individual cases, there is substantial financial risk for Microsoft and OpenAI.

Both companies offer an "opt-out" system for website owners to avoid use of their content in AI training. This suggests an acknowledgment of the potential for copyright infringement. 

Additionally, they have pledged to defend their customers from copyright claims and cover any legal costs that might arise from using AI-generated responses.

The companies now face claims from non-fiction authors and comedian Sarah Silverman, who accuse them of "massive and deliberate theft of copyrighted works." As the lawsuits progress, the outcome could shape how AI developers use copyrighted material in training data.
