Cornell Defendant Asks Court to Remove Letitia James From Rape Investigation Over Claims She Prejudged the Case

NEW YORK - A defendant caught in the middle of the explosive Cornell University sexual assault case has now turned the investigation itself into a court fight.

Attorneys for Gillio Lopes filed an Article 78 petition Wednesday in Albany County Supreme Court challenging New York Gov. Kathy Hochul’s appointment of Attorney General Letitia James as special prosecutor—or, alternatively, seeking to prevent James from personally directing the investigation and any prosecution that might follow. Lopes has denied sexually assaulting the woman identified publicly as Jane Doe. No criminal charges have been filed against him or the other men named in Doe’s civil lawsuit.

Lopes is not asking the court to stop investigators from examining what happened inside Cornell’s Chi Phi fraternity house in October 2024. His attorneys are attacking who gets to make the prosecutorial decisions.

Their argument focuses on a September 28 social-media statement issued through James’ office—three days before Hochul announced her appointment. James said what the young woman had been “forced to endure” was “horrific and unacceptable,” offered prayers for her and told her and other survivors, “We stand with you.”

The defense says those words matter because James was not merely commenting on sexual assault in general. She was commenting on this case before being placed in a position where she would decide whether the evidence justified criminal charges.

According to the petition, James had demonstrated “a bias and presumption of guilt” toward the defendants. The requested remedy is significant but targeted—the court could annul Hochul’s appointment or modify it so James does not personally direct the investigation or resulting prosecution.

This is where the dispute becomes more legally interesting than the headlines suggest.

An Article 78 proceeding is a New York procedure used to obtain judicial review of actions by state or local government officials and agencies. Lopes is not asking a criminal judge to declare him innocent. He is challenging the governmental decision that placed James in control of the investigation.

James has maintained that the inquiry will be driven by evidence, not predetermined conclusions. She said this week that her office is committed to a comprehensive investigation “guided only by the facts, the evidence, and the law.”Hochul has likewise defended the appointment, saying she has confidence James will examine the record and reach the proper conclusions.

The investigation was reassigned after Hochul sharply criticized Tompkins County District Attorney Matthew Van Houten’s handling of Jane Doe’s original complaint. Van Houten initially declined prosecution after relying heavily on a six-page Cornell police summary. He later acknowledged that his office had not received the complete picture, including a fuller transcript of Doe’s police interviews, and reopened the matter before Hochul replaced him with James.

Doe alleges in her civil case that she was plied with intoxicants and sexually assaulted by multiple men at the Chi Phi house. Cornell separately conducted an extensive university investigation and imposed sanctions ranging from expulsions and suspensions to lesser disciplinary measures. Cornell has since retained former Deputy U.S. Attorney General Sally Yates to conduct an independent review of the university’s handling of sexual-misconduct complaints.

But university discipline, a civil lawsuit and a criminal prosecution operate under very different rules and standards of proof.

That makes the Lopes petition worth watching. Prosecutorial fairness is not measured only by whether an official believes she can remain impartial. Courts may also confront whether government conduct creates a legally meaningful appearance that the outcome was prejudged.

At the same time, statements expressing support for an alleged victim do not automatically establish unlawful bias. James’ attorneys will have ample room to argue that compassion for Doe did not amount to a determination that Lopes—or anyone else—committed a crime.

That is now the question before the court.

Not whether Jane Doe deserves a full investigation. She does.

Not whether Lopes deserves an automatic dismissal. He does not.

The question is narrower and fundamental to the criminal justice system—whether the person deciding if accusations become criminal charges must enter that process without having publicly appeared to decide what happened first.
