Cornell Rape Case Raises a Difficult Question About False Allegations and What Research Actually Shows

NEW YORK - The explosive sexual-assault allegations surrounding Cornell University have produced a familiar collision between two fundamental principles of justice: allegations of rape deserve serious investigation, and accusations capable of destroying lives must still be tested against evidence.

A former Cornell student identified in court papers as Jane Doe alleges she was drugged and sexually assaulted by seven then-members of the Chi Phi fraternity during an October 2024 encounter. The defendants have denied wrongdoing. The controversy has returned to national attention after New York Gov. Kathy Hochul removed the local district attorney from the criminal investigation and assigned Attorney General Letitia James as special prosecutor.

The case has become particularly complicated because reports indicate Doe's descriptions of what occurred evolved after the encounter, while other evidence reportedly includes communications among fraternity members and questions about her level of impairment and ability to consent. Cornell conducted its own investigation and imposed disciplinary penalties on several students, while the original criminal investigation produced no charges.

That factual conflict raises a difficult question that receives considerably less careful treatment than it deserves: when sexual-assault allegations really are proven false, what does research tell us about why they are made?

The answer is more complicated than either side of the cultural debate often suggests.

One of the most widely cited American studies was published in 2010 in the peer-reviewed journal Violence Against Women. Researchers David Lisak, Lori Gardinier, Sarah Nicksa and Ashley Cote examined every sexual-assault report made to a major Northeastern university over a 10-year period.

Out of 136 reported cases, eight — 5.9% — were ultimately classified as false allegations under the researchers' criteria. After comparing their findings with earlier research, the authors concluded that rigorous studies generally placed false sexual-assault reports between approximately 2% and 10%.

The National Sexual Violence Resource Center similarly cites the 2% to 10% range when discussing false reporting.

But the definition of "false" is critical.

A rape allegation is not scientifically or legally established as false merely because prosecutors decline charges, a jury acquits a defendant, physical evidence is unavailable, witnesses disagree, an accuser changes portions of an account or investigators conclude they cannot prove the allegation beyond a reasonable doubt.

Those outcomes may mean the accusation cannot be proven. That is different from proving the accusation was fabricated.

Researchers have also studied the substantially smaller category of cases in which investigators determined that the allegation itself was false.

A 2017 study by André De Zutter, Robert Horselenberg and Peter van Koppen examined police files involving false rape allegations and attempted to determine what motivated them. The researchers identified recurring categories including obtaining an alibi, seeking revenge, obtaining attention or sympathy, pursuing a material benefit, regret, reinterpretation or relabeling of an encounter, and circumstances involving significant psychological disturbance.

The "alibi" category is particularly important because it does not necessarily mean a traditional alibi for a crime.

Researchers use the term more broadly to describe situations in which an accusation can provide an explanation for conduct the person fears having to explain — including consensual sexual activity, infidelity, staying somewhere unexpectedly or other behavior carrying perceived social or relationship consequences.

Revenge represents another recognized motive. In confirmed false-report cases, researchers have found accusations arising after interpersonal disputes, rejection, relationship conflict or perceived mistreatment.

Attention and sympathy can operate differently. Rather than seeking money or punishment, an accuser may obtain emotional support, concern from family members or intervention from authority figures.

Importantly, researchers have found that motivations can overlap. Human behavior rarely fits neatly into a single category.

That research should not be inverted into a presumption against sexual-assault complainants. Most sexual-assault reports are not classified as false, and the same scientific literature repeatedly warns against labeling a case fabricated simply because an account contains inconsistencies.

That distinction becomes especially important in cases involving alcohol, drugs, trauma and fragmented memory.

If a complainant's statements materially changed, investigators are entitled — and obligated — to determine why. Which statements were made first? What did contemporaneous text messages say? What did witnesses observe? What substances were consumed? What was the complainant's degree of impairment? What did the accused men say before they knew police might become involved? Do digital communications corroborate or contradict later accounts?

The same scrutiny must run in both directions.

Evidence suggesting an accuser initially described conduct as consensual cannot simply be ignored because a later allegation is more serious. Likewise, an earlier description of consent does not necessarily resolve whether consent continued throughout an encounter, whether additional acts occurred later or whether intoxication eventually rendered someone legally incapable of consenting.

That is precisely where forensic analysis differs from advocacy.

Investigators do not begin by deciding which person belongs to the more sympathetic category and then fitting the evidence around that conclusion. They reconstruct the timeline and determine which assertions are independently supported.

The Cornell defendants remain accused, not convicted. Jane Doe's allegations remain allegations, not judicial findings. The renewed criminal investigation may uncover evidence unavailable to the original prosecutor, or it may reinforce earlier doubts about whether a criminal case can be proved.

Research on false allegations cannot answer what happened inside the Cornell fraternity house.

What it can establish is that false sexual-assault allegations do occur, that researchers have documented recognizable motivations behind some confirmed cases, and that their relative rarity does not permit investigators to assume that any individual accusation must therefore be true.

The reverse is equally important.

A changing account does not automatically establish a lie.

The only defensible approach is the one demanded in every serious forensic investigation: preserve the evidence, test competing explanations, separate corroborated fact from allegation and allow the evidence — rather than public pressure — to determine what can actually be proved.
