A federal appeals court cleared the way on Friday for Texas authorities to enforce key provisions of a controversial law granting state officials the power to arrest and deport individuals suspected of crossing the U.S.-Mexico border illegally. The 2-1 decision injects fresh chaos into the ongoing battle over American immigration enforcement, handing Texas a massive legal victory over civil rights advocacy groups.

Appeals court overrides federal judge's block

The New Orleans-based 5th U.S. Circuit Court of Appeals issued an order putting an immediate freeze on a previous injunction. That earlier block, handed down on May 14 by U.S. District Judge David Ezra, came in response to a class-action lawsuit brought by civil rights groups representing thousands of non-citizens.

Judge Ezra originally halted the enforcement after determining that the Texas statute improperly infringed upon the federal government’s constitutional authority over immigration and naturalization. Republican Texas Attorney General Ken Paxton immediately fought the decision, escalating the battle to the conservative-leaning appeals court.

Local magistrates handed power to deport

The newly revived provisions of the 2023 law, widely known as SB 4, dramatically rewrite how immigration enforcement operates on the ground. Under the statute, local Texas magistrates receive the authority to bypass federal immigration courts entirely and issue direct deportation orders.

Furthermore, the law transforms illegal reentry into a state-level crime. This means individuals reentering the United States can face state prosecution even if they possess federal authorization or have since obtained valid green cards.

The legal path for SB 4 has twisted through multiple federal courts over the last two years:

1. April 2024: The 5th Circuit overturned an earlier injunction brought by the Biden administration, which had initially frozen the measure.

2. January 2025: The Trump administration dropped the federal lawsuit against Texas, opting not to challenge the state's border enforcement efforts.

3. May 2024: The 5th Circuit ruled 10-7 that original immigrant-rights organizations lacked standing, forcing advocates to restructure their lawsuit on behalf of directly impacted individuals.

Civil rights groups vow to fight back

Advocacy groups reacted with fierce condemnation following the late-Friday ruling. The American Civil Liberties Union (ACLU), along with its Texas branch and the Texas Civil Rights Project, lambasted the decision and promised immediate legal retaliation.

"We will continue to fight against this abhorrent and blatantly illegal law," the groups declared in a blistering joint statement.

Attorney General Ken Paxton’s office did not immediately issue a public comment following the ruling. Paxton, who is currently leveraging his aggressive border defense strategies in an active campaign for a seat in the U.S. Senate, has consistently argued that the federal government's historic border failures give Texas the legal right to defend its own territory.

What happens next at the border

The immediate activation of these enforcement powers changes the calculus for law enforcement agencies throughout the state of Texas. Local police forces and state troopers now possess the legal green light to question, detain, and process undocumented individuals under state criminal codes.
