DOJ Reveals Google’s High-Stakes Battle for Default Status in Thrilling Trial Opener

Washington, D.C. – In an electrifying courtroom showdown that promises to captivate the nation, the Justice Department has set the stage for a pivotal legal battle against tech giant Google. The trial, which kicked off on Tuesday in a D.C. federal court, exposes the lengths to which Google has gone to secure its status as the default search engine on smartphones and browsers, culminating in threats to withhold billions of dollars in revenue sharing from Apple, its long-standing partner

In an opening spectacle that could rival any blockbuster, the first day of the two-month bench trial was ablaze with revelations. Google and the U.S. Department of Justice clashed fiercely over allegations that Google had aggressively pursued its goal of remaining Apple's preferred choice for web searches on the Safari browser.

Apple's Brush with Alternatives

The crux of the matter emerged when Apple contemplated making a bold move in 2007, considering alternatives to Google as the default search engine. The Justice Department's attorney, Kenneth M. Dintzer, unveiled a chilling warning issued by Google at the time: "No default placement — no revenue share." A menacing ultimatum that sent shockwaves through the tech world.

Fast forward to 2016, when Apple renegotiated its default contract with Google. Dintzer revealed that Google had meticulously calculated the potential consequences if Apple were to switch to Bing. While the exact figures remain cloaked in secrecy, Dintzer described the stakes as "significant." Google itself had declared the loss of default search status on Apple as a "code red situation."

Judge Mehta's Weighty Decision

U.S. District Judge Amit Mehta now bears the responsibility of unraveling this complex web of legal intrigue over the next two months. He must determine whether Google's contractual agreements with smartphone manufacturers, browser developers, and wireless carriers unlawfully exclude rivals like Bing and DuckDuckGo from entering the market and obtaining the critical user data needed for competitiveness.

Dintzer contended that "Google's scale hermetically seals it from competition," emphasizing the insurmountable advantage it has amassed.

To counter Google's assertion that the market extends beyond general search, Dintzer referenced Google's own internal documents that distinguish general search from social media and vertical search. He argued that general search is unique, scouring the entire open internet in ways that alternatives cannot.

DOJ Targets Google's Revenue Sharing Agreements

The Justice Department's case, initiated in October 2020, primarily targets Google's revenue sharing agreements with browser companies and mobile application distribution agreements with smartphone manufacturers. Dintzer argued that Google's insistence on being the default search engine on every U.S. Android phone leaves no room for competitors.

In parallel with the DOJ's efforts, a coalition of state attorneys general, led by Colorado, is pursuing a separate but overlapping lawsuit. William F. Cavanaugh Jr. of Patterson Belknap Webb & Tyler LLP argued on behalf of the states, focusing on allegations related to Google's design of its SA360 search engine marketing tool, which enforcers claim discriminates against Microsoft.

John E. Schmidtlein from Williams & Connolly LLP spearheaded Google's defense, contending that Google is not obligated to tailor its products to Microsoft's preferences or timeline. He disputed allegations that Google's market power stifled competition, pointing out that Bing, not Google, dominates all Windows computers. Schmidtlein claimed users migrate to Google voluntarily because it helps them find what they seek.

A Battle of Markets and Monopolies

Schmidtlein challenged the notion that Google's monopoly precludes its pursuit of default status. He asserted that the court cannot interfere in the market and dictate Google's competitive choices.

The trial's dramatic undertones were heightened as the DOJ called its first witness, Google's in-house chief economist, Hal Varian. Varian's testimony, though not yet complete, set the stage for further confrontations. He exhibited extensive preparation, offering minimal responses and seeking clarification even on terms as commonplace as "many."

Google's Inner Workings Exposed

Dintzer employed Varian's testimony to shed light on Google's perception of general search as a separate category and its aggressive stance on maintaining default status. The court heard how Google viewed Microsoft's entry into the search market as a "serious threat" and its strategies to hinder competition.

Varian's Resistance and Antitrust Scrutiny

Varian, in an act of defiance, resisted most of the government's questions, including those relating to his own conclusions. He maintained that competition and superior products were his focus, challenging assertions that Google was merely "good enough."

The Battle Ahead: Data and Deception

As the trial unfolds, one can expect the battle to intensify. The courtroom will delve into allegations of Google's concealment of vital evidence through chat deletion policies and misuse of privilege.

The Verdict Remains Uncertain

As the first day's proceedings came to a close, the courtroom buzzed with tension. Judge Mehta's role as the ultimate arbiter in this high-stakes legal showdown adds to the intrigue. The trial promises to unravel more mysteries, expose hidden agendas, and determine whether Google's stranglehold on default status warrants legal intervention.
