A dispute over a few extra days' wait for a final paycheck has quietly moved toward resolution. Elevance Health Inc. has agreed to a settlement in principle that would close out a proposed class action alleging the company failed to pay discharged workers their final wages promptly, in violation of state law in both Connecticut and Massachusetts.

The Case Moves Toward Closure

The insurer and named plaintiff Molly Sekelsky, who previously worked as a utilization representative before her termination in April 2024, asked a Hartford Judicial District judge Thursday for 60 days to finalize their agreement and prepare the associated court paperwork. Judge Elizabeth J. Stewart granted that request Friday, setting the timeline for the settlement's completion.

The Allegations at the Heart of the Case

The most recent version of Sekelsky's complaint, filed in September 2025, alleged Elevance paid her final wages in three separate deposits — two of which arrived four days after her termination, with the third landing a full two weeks later.

Two States, Two Sets of Wage Laws

According to the complaint, those staggered direct deposits violated Connecticut wage law, which requires final paychecks to be issued on the business day following termination. The complaint also alleged a violation of Massachusetts law, which mandates payment on the actual day of discharge — a stricter standard than Connecticut's. Sekelsky sought penalty damages on behalf of a proposed class of former Elevance employees in both states.

Elevance's Defense

In an October 2025 motion seeking to strike the complaint, Elevance pushed back against the underlying premise of the lawsuit, arguing that Connecticut's wage law exists to ensure workers ultimately receive all wages owed to them — "not to subject employers who have paid all wages" to class action liability over what the company characterized as mere "technicalities." Elevance also argued that Sekelsky hadn't demonstrated Massachusetts law should even apply to her, given that she resided in Connecticut while working in Massachusetts.
