Sources familiar with the matter said the Federal Communications Commission is preparing to call in the station licenses of The Walt Disney Company for early renewal—an extraordinary step rarely seen in modern regulatory practice.

The move follows mounting pressure from Donald Trump, who has urged ABC to dismiss late-night host Jimmy Kimmel after controversial remarks tied to a recent shooting incident.

Unprecedented regulatory action looms

Early renewal could trigger lengthy legal battle

The FCC’s potential filing—expected as early as Tuesday—would target licenses for eight ABC-owned stations in major cities, including New York and Chicago, even though their renewal deadlines are years away.

Such an early review would represent a sharp escalation, raising concerns that regulatory authority is being used as leverage in a political dispute.

While station license holders have broad legal protections, the process itself could force ABC into a costly and time-consuming defense, regardless of the outcome.

FCC Chair Brendan Carr previously hinted at the possibility, noting that federal law allows the agency to revisit licenses ahead of schedule.

Disney stands firm as Kimmel addresses backlash

Despite the pressure, Disney has shown no sign of backing down. The company declined immediate comment on the potential action but continued airing Kimmel’s show—an implicit signal of support.

During his Monday monologue, Kimmel addressed the controversy surrounding his remark about First Lady Melania Trump, describing it as a joke referencing age differences.

He emphasized that his comments fall under constitutionally protected speech, stating that all Americans, including public figures, have the right to express themselves under the First Amendment.

Free speech concerns take center stage

Critics warn of government overreach

If the FCC proceeds, the dispute is expected to evolve into a major First Amendment battle, with critics arguing that the government is attempting to penalize a broadcaster for content it aired.

FCC officials are expected to frame the review as part of an ongoing investigation into Disney’s diversity, equity, and inclusion practices rather than directly linking it to the Kimmel controversy.

Still, skepticism remains widespread.

Anna Gomez, the agency’s lone Democratic commissioner, called the reported plan “unprecedented” and unlikely to succeed, urging companies to challenge it.

Advocates for press freedom echoed that sentiment. Seth Stern said federal law does not allow the FCC to use licensing authority as a tool to punish protected speech, warning that such actions could blur the line between regulation and censorship.

Parallel probes and political undertones

The controversy unfolds alongside other FCC scrutiny of ABC programming, including a prior inquiry into whether the talk show “The View” violated “equal time” rules—long a point of contention among conservative critics.

Meanwhile, the agency recently initiated action against a smaller broadcaster, signaling a renewed willingness to flex enforcement powers that have largely remained dormant for decades.
