Federal Judge Issues Stern Warning to Alina Habba and ICE After Newark Mayor’s Arrest—Signals Sharp Reproach Over Public Comments

[NEWARK, NJ] - In a moment that has gripped headlines and fired up political tensions, Newark Mayor Ras Baraka found himself behind federal bars on Friday after a confrontational entry into the Delaney Hall ICE detention facility. But what started as a protest-turned-arrest has escalated into a legal and ethical showdown between federal prosecutors and the judiciary—one with significant implications for both law enforcement conduct and Baraka's gubernatorial ambitions.

Federal Magistrate Judge André M. Espinosa issued a sharp warning during an extraordinary 18-minute virtual hearing, cautioning U.S. Attorney Alina Habba and ICE officials to refrain from making extrajudicial comments about the case.

"To the extent anyone has made such comments," Espinosa stated, "I would caution them to heed carefully to the rules of professional conduct and the boundaries of propriety for public comment related to an ongoing investigation and/or prosecution."

This came after Baraka’s defense attorney, Raymond Brown, requested the court intervene and admonish Trump administration officials for what he characterized as politically motivated attacks disguised as public statements.

According to reports, Ras Baraka stormed through the gate of the Delaney Hall facility and began shouting at Immigration and Customs Enforcement agents. Baraka, flanked by three congressional Democrats from New Jersey, was demanding access inside.

The confrontation quickly escalated. Federal agents on-site ordered Baraka to stand down. When he refused, he was placed under arrest for criminal trespass.

Alina Habba did not mince words. Just hours after the arrest, she issued a bold statement on social media:

“The Mayor of Newark, Ras Baraka, committed trespass and ignored multiple warnings from Homeland Security Investigations to remove himself from the ICE detention center in Newark, New Jersey this afternoon. He has willingly chosen to disregard the law. That will not stand in this state. He has been taken into custody. NO ONE IS ABOVE THE LAW,” Habba said.

Baraka was released later that evening, with the court determining he posed no flight risk.

The drama doesn’t end there.

On Monday, Habba announced a broader federal investigation into the physical confrontation and political circumstances that unfolded at Delaney Hall.

“My office is undertaking a thorough investigation in coordination with our Federal Agency partners of what transpired on Friday at Delaney Hall. As is true of every investigation this office handles, all available evidence will be thoroughly reviewed prior to making a determination on how to proceed. I do not take these matters lightly,”Alina Habba said.

Mayor Baraka is campaigning to become New Jersey’s next governor, and Friday’s events may either solidify his standing among civil rights activists or complicate his candidacy, depending on how the legal case unfolds.
