What Law Students Need to Know

• The dispute now centers on whether the ABA’s accrediting council is truly independent from the larger American Bar Association.

• The Sept. 23 vote deadlocked, but the Education Department—not the advisory panel—will ultimately make the recognition decision.

A federal advisory panel spent roughly seven hours Wednesday debating whether the American Bar Association should remain the federally recognized accreditor for U.S. law schools—and ended without an answer. The National Advisory Committee on Institutional Quality and Integrity, or NACIQI, deadlocked 8-8 on a proposal to continue recognition for 12 months while requiring corrective action. A later proposal to deny recognition also deadlocked, and the matter was ultimately tabled 8-7.

The fight is not simply over DEI. The Education Department’s August staff report recommended denying renewed recognition after finding the ABA Council of the Section of Legal Education and Admissions to the Bar out of compliance with numerous federal recognition criteria. What drove Wednesday’s stalemate was whether that council is sufficiently “separate and independent” from the broader ABA.

Department officials and some committee members pointed to continuing ties involving changes to accreditation standards, financial administration, council membership and meeting logistics. The accreditation council maintains that those administrative connections do not compromise its independent authority over accreditation decisions.

DEI remains part of the record, but its role has changed dramatically. On Sept. 8, the accreditation council repealed Standard 206, which had required law schools to demonstrate concrete action toward diversity and inclusion. The Education Department had criticized the council for not responding quickly enough after the Supreme Court’s 2023 affirmative-action ruling.

For students, the immediate financial-aid risk is narrower than the national headline suggests. The ABA council accredits nearly 200 law schools but acts as the direct federal-aid gatekeeper for only just over a dozen freestanding schools. Most university-based law schools also fall under institutional accreditors, meaning their federal-aid eligibility would not automatically disappear if the ABA council lost federal recognition.

There is another important distinction: federal derecognition would not automatically cancel the ABA accreditation of every law school or immediately prevent graduates from taking the bar. States—not the ABA or Education Department—set their own bar-admission requirements. Every U.S. jurisdiction currently recognizes graduation from an ABA-approved law school as satisfying its legal-education requirement, although individual rules vary.

And those rules are already changing. Texas has ended ABA exclusivity. Florida’s broader accreditation framework takes effect Oct. 1, 2026, while Alabama’s revised rules take effect Jan. 1, 2027. Ohio and Tennessee have also been considering changes.

That is where this could eventually touch law students across the country. If federal recognition changes, state supreme courts and bar examiners may have to examine rules that depend upon ABA approval or a federally recognized accreditor—and students could face a more fragmented system when trying to move between states.

As of Sept. 24, NACIQI’s two-day meeting remained scheduled through 5 p.m. Eastern. Even if the committee reaches a recommendation, it is advisory. Federal regulations generally require the Education Department’s senior official to issue the recognition decision within 90 days of the NACIQI meeting. The Department can renew recognition, require monitoring or corrective compliance, limit or suspend recognition, or deny it.

And even denial would not necessarily end the fight. The ABA council could appeal to the Education Secretary, and federal rules expressly provide that an appeal stays the adverse decision while that appeal is pending. Judicial review can follow.
