Gemini Insurance Company Tells Judge An Older Lawsuit Shuts Ad.com Out of Trademark Coverage

CALIFORNIA - A trademark lawsuit against digital advertising company Ad.com has produced a second legal fight — this one over who must pay the lawyers.

Gemini Insurance Company asked a California federal court to rule that it did not breach its insurance contract when it refused to defend Ad.com Interactive Media Inc. against trademark claims brought by Shopnomix LLC and Pronomix.ai LLC.

The coverage case is Ad.Com Interactive Media, Inc. v. Gemini Insurance Company, Case No. 2:26-cv-02300, pending in the U.S. District Court for the Central District of California. Ad.com filed the action March 4, 2026, asserting declaratory relief, breach of contract and breach of the implied covenant of good faith and fair dealing.

The dispute sounds technical. Financially, it is anything but.

Gemini's position is that the trademark claims are related to an earlier Shopnomix dispute that arose before the applicable policy period. If the court accepts that interpretation, the later lawsuit can effectively be treated as having been made when the earlier related matter arose — putting it outside the coverage window.

That is the power of a ‘related claims’ provision.

Think of it this way: A company buys insurance for 2025. A major lawsuit arrives during that policy year. Ordinarily, the timing appears favorable. But if the insurer establishes that the lawsuit is sufficiently connected to a dispute originating before the policy began, the policyholder may find that the claim is legally treated as old rather than new.

Ad.com disputes Gemini's characterization. According to its coverage complaint, the earlier and later disputes involve different claims and facts and should not be bundled together for insurance purposes. Ad.com also contends its policy's definition of a wrongful act is broad enough to reach the allegations made against it.

The underlying federal trademark case is, Shopnomix LLC et al. v. Ad.com Interactive Media Inc., Case No. 2:25-cv-10802. Shopnomix and Pronomix.ai accused Ad.com of using their marks in connection with competing advertising and technology services. The litigation includes Lanham Act trademark claims, and a federal judge granted temporary restraining relief in November 2025.

Ad.com tendered the matter to Gemini in December 2025. Gemini denied coverage the following month, according to Ad.com's complaint. Ad.com alleged when it filed its insurance case that it had already spent more than $75,000 defending itself.

There is another wrinkle.

Ad.com argues that allegations of intentional or willful trademark infringement do not automatically eliminate Gemini's defense obligation because an endorsement allegedly requires the insurer to defend intentional-misconduct claims until the conduct is established through an admission, judgment or adjudication.

That distinction matters. An allegation is not a finding.

The insurance case is moving toward a potentially decisive stage. The court's scheduling order set December 16, 2026, for a hearing on cross-motions for summary judgment or adjudication.

For businesses buying professional liability, media or technology-related coverage, this litigation carries a practical warning: the effective reach of insurance can depend as much on the definition of “related claims” as it does on the dollar limits printed on the declarations page.

A multimillion-dollar policy can look substantial. But if an insurer successfully moves the claim's legal starting date backward in time, those limits may never come into play.

No court has yet ruled that Gemini's coverage position is correct.
