On December 21, 2022, the jury in the current Harvey Weinstein trial delivered a mixed verdict. Harvey Weinstein was accused of multiple crimes, facing charges such as sexual assault and rape. While the jury remains undecided on specific charges, they did find Weinstein guilty of rape and sexual assault of a victim known as Jane Doe 1, however remains deadlocked on decisions for two of Weinstein's other accusers. Jurors were interviewed after the trial, with one juror having the following to say regarding the undecided counts:

"Everybody seemed very believable — it's just hard to prove all it through time and memory, and it's their word against, you know, it's just their word," Jay said. "And then you look at everything else that transpired, all of the actions afterward and sometimes before, and so you just try to put it all together."

One of the victims attorneys hired a jury consulting firm from Magna Legal Services to assist with the trial. One of the partners for the firm, Mark Calzaretta, believes that without physical evidence, the jurors may judge the victims who did not received a decision, "

They're going to judge them," Calzaretta said. "I don't think it's necessarily blaming the victim, but when you have somebody who it's their word against somebody else's, does it fit the construct that the jurors believe is a reasonable construct and reasonable action?"

With some of the victims continuing a cordial sort of "friendship" with Weinstein after their assaults, there are thoughts of the jury possibly not believing the the accounts of the victims. One of the victims, Siebel Newson, wife of Gavin Newson, remained friendly with Weinstein after the rape, apparently exchanging at least 35 emails after the rape in 2005. This appears to be concerning for some of the jurors. Regarding Siebel Newson, Calzaretta had this to say: "With certain victims that testified, like ... with the governor's wife, for example, you're talking about coming back years and years later after a lot of these alleged assaults occurred and then, you know, there's like not a lot of physical evidence. A lot of their behavior gets questioned now."
