WASHINGTON, DC - First Lady, Melania Trump just turned up the heat on Hunter Biden. After the first lady’s lawyer labeled Biden’s Epstein-related remarks “false, defamatory” and “extremely salacious,” she issued a pre-suit demand for a public apology, a full retraction, and warned of litigation she values in damages at $1 billion if he refuses.

Biden’s allegation — that sex offender Jeffrey Epstein introduced Melania to Donald Trump — has been denied for years. The standing account is that the couple met at a New York Fashion Week party in 1998 hosted by modeling agent Paolo Zampolli. That version has been reported repeatedly, including by mainstream outlets and Zampolli himself.

In his interview, Hunter Biden said his allegation traces back to author Michael Wolff. President Trump has previously dismissed Wolff as a “third-rate reporter.” Defamation attorneys caution that if you’re making a statement likely to draw litigation, your primary support shouldn’t be a Hollywood trade article—or a commentator with an obvious bias toward the subject of your claim.

What Hunter Said — And Why It’s Risky

In the Channel 5 appearance, Biden asserted, “Epstein introduced Melania to Trump,” and then, in a follow-up interview titled as an “apology,” refused to apologize: “F*** that — that’s not going to happen.” Those comments, now amplified across social media and re-reported by major outlets, are the focal point of Melania’s demand.

From a defamation standpoint, public figures like Melania Trump must prove actual malice — that a defendant knew a statement was false or acted with reckless disregard for the truth. That standard, set by New York Times v. Sullivan, remains the governing rule and was just left intact when the Supreme Court declined a recent bid to revisit it. If Melania files, the fight will turn on whether Biden’s reliance on retracting sources and contested claims shows reckless disregard.

The Demand Letter — What It Asks For

The August 6 letter from Melania’s litigation counsel, Alejandro Brito. The letter demands that Biden (and his counsel, Abbe Lowell) ensure the statements are removed and retracted, along with a public apology. It asserts “overwhelming financial and reputational harm” from widespread dissemination — language that previews a damages theory if this becomes a full suit.

Where This Could Be Filed — And Why Venue Matters

District of Columbia: D.C. has an Anti-SLAPP statute (D.C. Code § 16-5501 et seq.) that allows an early special motion to dismiss speech claims tied to public issues. But the D.C. Circuit’s Abbas v. Foreign Policy Group decision holds that the D.C. Anti-SLAPP mechanism does not apply in federal diversity cases, because Federal Rules 12 and 56 “answer the same question.” Translation: if the case lands in D.C. Superior Court, Anti-SLAPP is in play; if it’s removed or filed in federal court, the Anti-SLAPP tool may be off the table — a strategic fork in the road for both sides. D.C. Law Library

Delaware: Delaware’s Anti-SLAPP law is narrow, largely limited to petitions involving public applicants/permittees (e.g., land-use contexts). A standard defamation claim between private parties over public-interest commentary typically won’t trigger it. Bottom line: Expect venue maneuvering. The first lady’s team could prefer a forum where Anti-SLAPP’s procedural hurdles don’t apply (e.g., federal court in D.C. or a state with weak Anti-SLAPP protections), whereas Biden would want the opposite.

What Melania Would Need to Survive an Anti-SLAPP (and Ultimately Win)

  • Pin down falsity: Lean on longstanding, on-record accounts (Zampolli’s 1998 Fashion Week introduction) to establish the allegation is false. CNN Page Six
  • Prove actual malice: Emphasize Biden’s reliance on a claim tied to a story that was retracted and the absence of independent verification — classic “reckless disregard” factors. Poynter

The Other Side of the Ledger

Biden’s potential defenses would include:

  • Truth/substantial truth (if he can substantiate it),
  • Lack of actual malice (he cited published material and a named author), and
  • Opinion/qualified privilege arguments depending on how the statements are framed.
    But the retraction of a key media story and the lack of corroborating, reliable sourcing introduce real exposure if a complaint is filed.

The Road Ahead

For now, this is a demand letter — not yet a lawsuit. But it sets the stage for a venue chess match and an early, high-stakes skirmish over Anti-SLAPP. If Melania files and clears procedural hurdles, the merits will hinge on whether Biden’s comments crossed from speculation into actionable falsehood expressed with reckless disregard.
