Joaquin Altenberg Faces Upcoming Trial In Fraud Case

Joaquin Elias Altenberg is currently facing trial in an alleged fraud case.

Timing is bad for Altenberg, whom recently had a motion denied to delay his upcoming fraud trial.   According to public records, the court opined "The request for an extension is denied.   This case has dragged on for too long, and there has been too much questionable behavior by the defendants to warrant further delay."

Also accused of fraud is the wife of Joaquin, Alison Altenberg.   Alison is the daughter of the esteemed professor Leonard E. Weisman, a West Point graduate whom is currently a Professor at the Baylor College of Medicine.

The fraud case stems from an investment made by HOMF II in a fund to finance renewable energy development projects. These projects were to be selected by the Fund’s managing member, Joaquin Altenberg (Alison’s husband).    Altenberg graduated from Harvard Business School and is an experienced business operator.

It appears that Joaquin and Alison are jumping around from attorney to attorney in the case.   Most recently, David L. Finger, renowned nationally as a top lawyer in Delaware, withdrew as counsel.

Timeline Of Alleged Delays By Defendants

On December 7, 2017, the Court entered the Stipulation and [Proposed] Trial Scheduling Order which, among other things, set trial for September 5-7, 2018.

On April 27, 2018, Richards, Layton & Finger, P.A. filed its motion to leave to withdraw as Defendants' counsel.

On May 2, 2018, the Court entered an order granting the motion to withdraw filed by Richards, Layton & Finger, P.A., which provided VERT Solar Finance, LLC with 30 days to obtain new counsel.

On June 1, 2018, Finger & Slanina LLC entered its appearance on behalf of Defendants and the Fund.

On August 20, 2018, the Court entered the Amended Stipulation and [Proposed] Trial Scheduling Order which, among other things, set trial for November 28-30, 2018.

On November 6, 2018, at the request of counsel for the Defendants, the trial schedule for November 28-30, 2019 was postponed.

On January 17, 2019, the Court entered the Second [Proposed] Trial Scheduling Order which, amonth other things, set trial for May 22-24, 2019.

On April 1, 2019, then-counsel for Defendants filed a motion to withdraw as counsel to Defendants and the Fund.

On April 4, 2019, the Court entered an order granting the Motion, but required VERT Solar Finance, LLC to obtain counsel within 30 days of the entry of the order granting the Motion.

On May 6, 2019, Defendants requested an extension of time until May 27, 2019 to obtain counsel because, among other things, VERT Solar Finance, LLC and the Fund were in the process of filing bankruptcy.

On May 7, 2019, the court denied Defendants' request for an extension because "[t]his has dragged on far to long, and there has been too much questionable behavior by the defendants to warrant further delay."

On May 15, 2019, Plaintiffs filed a Motion for Default Judgement against VERT Solar Finance, LLC, a Motion for Summary Judgement against Joaquin Altenberg, and a MOtion to Amend the Amended Complaint.

On May 22, 2019, Wilks, Lukoff and Bracegirdle LLC entered its appearance on behalf of Defendants.

Trial in the fraud case has been finally set for September 23-25, 2019.  Finally!    The full order is below.

According to his LinkedIn profile, Joaquin Altenberg is currently the CFO of Vax-Immune and is in charge of ead fundraising, business strategy, business development and operational support.   Additionally, Altenberg has started a new company called Clean Energy Nexus.

UPDATE:   Joaquin Altenberg was arrested for assault this past December.  Subsequent to that the case was dismissed and ordered to be sealed.
