Judge Newman Wins Independent Review As Chief Justice John Roberts Transfers Disability Case to 11th Circuit

What Changed for Judge Newman

  • Judge Pauline Newman has finally received what she sought for more than three years — review outside her own Federal Circuit.
  • The Eleventh Circuit Judicial Council has substantial discretion over where to restart the proceeding, creating unanswered questions about how much of the earlier process it will revisit.
  • Newman remains suspended from new case assignments for now, but the transfer places the dispute before judges who were not participants in the original investigation.

For more than three years, Judge Pauline Newman, age 99, has said  that the judges investigating whether she remained fit to serve should not also be the judges deciding the dispute.

She has finally gotten her wish.

Chief Justice John Roberts transferred the judicial disability proceeding involving the 99-year-old Federal Circuit judge to the Eleventh Circuit Judicial Council on August 19, 2026. The move remained undisclosed until October 6, when Eleventh Circuit Chief Judge William Pryor granted Newman’s request to make the existence of the transferred proceeding public.

That may sound procedural. It isn't.

The Federal Circuit suspended Newman from receiving new cases in 2023 after concluding that she refused, without good cause, to cooperate with its investigation by undergoing requested medical testing, producing records and participating in an interview. Newman maintained that she had legitimate due-process objections to an investigation being conducted by colleagues she viewed as accusers, witnesses and adjudicators.

Her request was straightforward — send the matter somewhere else.

The Federal Circuit refused. The Judicial Conference's Committee on Judicial Conduct and Disability later upheld the sanction. Newman challenged the process in federal court, but the D.C. Circuit ruled in August 2025 that binding precedent prevented judicial review of several of her statutory and as-applied constitutional claims. The Supreme Court declined to take her case in June 2026.

Then came Roberts' transfer.

The critical detail is buried in Rule 26 of the Rules for Judicial-Conduct and Judicial-Disability Proceedings. When a complaint is transferred, the receiving judicial council determines the "proper stage" at which consideration should begin. The official commentary specifically contemplates possibilities including sending the matter to the new chief judge or appointing a new special committee.

That means the Eleventh Circuit is not necessarily locked into simply accepting every procedural choice the Federal Circuit made.

But exactly what happens next remains unclear.

The Eleventh Circuit could examine the existing record, require additional proceedings, create a special committee, seek new medical evidence or otherwise determine how the transferred matter should move forward within the Judicial Conduct and Disability Act. Newman's current suspension remains in place in the meantime.

Transparency will also be limited. Rule 23 generally makes consideration of judicial-disability complaints confidential, although a judicial council may disclose the existence of a proceeding when appropriate to maintain public confidence. That explains why the public knows the transfer occurred without necessarily being able to watch each step that follows.

For Newman, however, the transfer itself matters.

Rule 26 says transfers may be appropriate when internal tensions exist, when a case is highly visible and local disposition could weaken public confidence, or when the complaint raises questions about governance of the home court. Those examples closely resemble the concerns Newman has raised throughout this fight.

None of that guarantees Newman reinstatement.

It does something more basic — and long overdue. Judges who were not part of the Federal Circuit controversy will now decide what should happen next.
