Judge Upholds FBI Seizure of 2020 Georgia Election Records in High-Stakes Legal Fight

A federal judge in Georgia has ruled that the FBI can retain roughly 660 boxes of 2020 election records seized from Fulton County, rejecting a demand to return the materials and intensifying a politically charged legal battle tied to the aftermath of the 2020 presidential election.

The decision lands at the center of an escalating dispute over election integrity, federal authority, and the continuing fallout from Donald Trump’s loss in Georgia, a state he narrowly lost to Joseph R. Biden Jr. by fewer than 12,000 votes.

FBI Seizure Sparks Constitutional Clash

The controversy began after FBI agents executed a sweeping search warrant on Jan. 28 at Fulton County’s election hub, a warehouse outside Atlanta. Agents removed about 660 boxes containing ballots, voter rolls, and scanner images.

Fulton County quickly moved to challenge the operation, filing a lawsuit in early February that called the search unconstitutional and demanded the return of all seized materials.

County officials argued the federal action violated Fourth Amendment protections against unreasonable searches and seizures, escalating the case into a broader confrontation with federal authorities.

Judge Acknowledges Concerns but Sides With Federal Government

U.S. District Judge J.P. Boulee of Atlanta, appointed during Trump’s first term, acknowledged concerns about the case but ruled the legal threshold to return the materials had not been met.

“This Court acknowledges that the events leading up to this case are, in a variety of ways, unprecedented,” Judge Boulee, who was appointed to the federal bench during President Trump’s first term, wrote in his 68-page order. But he said that the county had not shown that the federal government had displayed “callous disregard” for the constitutional rights of the county.

He noted that while parts of the case were “troubling,” the evidence presented did not justify forcing the federal government to give the records back.

Political Fallout and Election Year Tensions

The ruling has reignited political tensions surrounding the 2020 election, which Trump has repeatedly disputed despite courts and officials rejecting claims of widespread fraud.

Fulton County Board of Commissioners Chairman Robb Pitts criticized the federal action when the lawsuit was filed.

“Our Constitution itself is at stake.”

Pitts said Wednesday that the county strongly disagreed with the ruling and signaled it may appeal.

“Our fight has exposed the flawed affidavit and suspicious timeline of federal actions,” Mr. Pitts said in the statement. “We will continue, as always, to stand by our election workers and the voters of Fulton County. We intend to vigorously pursue all available legal options.”

Debunked Claims and Broader Election Debate

Fulton County argued in court filings that the warrant was based on claims about the 2020 election that had already been repeatedly debunked.

According to county records, at least 11 lawsuits challenging Georgia’s 2020 election results were filed. None found evidence of widespread fraud or misconduct.

“Claims that the 2020 election results were fraudulent or otherwise invalid have been exhaustively reviewed and, without exception, refuted,” the county’s complaint stated, calling the federal search a “gross intrusion” into state election authority.

Brad Raffensperger, Georgia’s Republican secretary of state, has also criticized the investigation as a misuse of resources.

Some Trump supporters celebrated the ruling. Mark Davis, a contributing writer for The Federalist, called it a major win for election integrity in a social media post.

Election law experts, however, raised concerns about the origins of the investigation. Wendy Weiser of the Brennan Center for Justice at NYU Law School said the process began with a well known election denier and relied on claims that had already been disproven.

“But if there’s ever an extraordinary time that this should happen, I think this was that,” Weiser said, referring to judicial intervention in search warrant disputes.

Ongoing Legal and Political Uncertainty

The Justice Department has also sought identifying information about every worker involved in Fulton County’s 2020 election operations, according to court records, though its intent remains unclear.

As of Wednesday, none of the seized records had been returned, according to a Fulton County spokesperson.

The FBI declined to comment on the ruling, and the Justice Department did not respond to requests for comment.

With Georgia already in early voting for its primary and Election Day set for May 19, the case continues to unfold against a backdrop of renewed national debate over election rules, voter access, and federal oversight.
