BOSTON — Nearly eight years after a man wanted by federal immigration authorities slipped out a side door of a Newton courthouse, the state's highest court has closed the book on the judge who presided that day. The Massachusetts Supreme Judicial Court on Thursday issued a public reprimand against Judge Shelley Joseph, finding that her conduct during the 2018 hearing created an appearance of impropriety, even though investigators found no evidence she orchestrated the escape herself.

The reprimand caps a case that once carried the weight of a federal prosecution. Joseph, now a Boston Municipal Court judge, was indicted in 2019 on obstruction of justice charges tied to the incident, part of a broader clash between the first Trump administration and local courts over immigration enforcement. Those charges were dropped in September 2022 after Joseph reached a deferred prosecution agreement that required her to refer the matter to the state's Commission on Judicial Conduct instead.

The underlying facts trace back to April 2, 2018, when Jose Medina-Perez, a twice-deported Dominican national barred from reentering the country until 2027, appeared before Joseph in Newton District Court on state drug and fugitive-from-justice charges. An ICE agent was waiting to take him into custody. According to the commission's findings, defense attorney David Jellinek — after failing to resolve a dispute over Medina-Perez's identity with the agent directly — arranged with a court officer to have his client led through the courthouse's secured lockup area and out a back exit instead of the public lobby, where the agent expected him to emerge.

Joseph requested a sidebar conference with the attorneys that included a brief, off-the-record exchange about the ICE detainer, and she later directed the courtroom clerk to shut off the recording equipment — a violation of District Court rules. Those actions became the crux of the disciplinary case, even after the more serious federal allegations fell away.

Following a public hearing held over several days in June 2025, hearing officer Denis J. McInerney, a former federal prosecutor now with Davis Polk & Wardwell, released a 117-page report in November concluding there was no credible evidence Joseph knew about or approved Jellinek's plan. But he found her sidebar remarks and handling of the recording created what he called an appearance of impropriety and bias, warranting discipline. McInerney noted the violation would ordinarily merit only a private reprimand, but he recommended a public one given how extensively the case had already played out before the public.

The Commission on Judicial Conduct forwarded that recommendation to the Supreme Judicial Court, which heard oral arguments in May. Joseph's attorneys pushed for dismissal, arguing that publicly punishing a judge for compassionate, split-second courtroom decisions could chill judicial discretion across the Commonwealth's busy trial courts, where judges often rule without the benefit of law clerks or lengthy deliberation. The commission's special counsel countered that the reprimand was warranted regardless of intent, given the rule violations and the appearance problems it created.

In issuing the reprimand Thursday, the SJC sided with the recommendation from both its hearing officer and the commission, closing the case without further discipline. Joseph, who draws an annual salary of roughly $207,855 in her current post, retains her position on the bench.

The case became a touchstone in the national debate over how far judges can go to protect people appearing before them from federal immigration enforcement, a tension that has resurfaced in other states, including a similar prosecution involving a Wisconsin judge. For Joseph, the reprimand represents a lesser outcome than either the criminal exposure she once faced or the indefinite suspension the commission's own formal charges had initially sought — but it also formally brands her official record with a public rebuke over how she handled one of the most closely watched courtroom episodes in recent Massachusetts history.
