McDonald’s Sued Over ‘Sugar-Free’ Coffee Drinks Allegedly Containing Up to 18 Grams of Sugar

What's Brewing Behind the Lawsuit

  • Eight McCafé beverages allegedly contain as much as 18 grams of sugar despite being marketed as sugar-free.
  • FDA regulations generally require less than 0.5 grams of sugar per serving for products advertised as sugar-free.
  • The lawsuit follows similar litigation against Starbucks and raises questions about how restaurants describe beverages containing naturally occurring milk sugars.

ILLINOIS - McDonald’s is facing a new federal class-action lawsuit accusing the fast-food giant of misleading customers into believing certain McCafé beverages contain no sugar when, according to the plaintiffs, some contain as much as 18 grams per serving.

The lawsuit, Camacho et al. v. McDonald’s Corporation et al., Case No. 1:26-cv-13821, was filed Friday, November 6, 2026, in the U.S. District Court for the Northern District of Illinois. Three consumers are challenging the company's advertising of eight coffee beverages, alleging the descriptions violate federal food-labeling standards and state consumer-protection laws.

According to the November 6 announcement from plaintiffs' attorneys, the disputed products include French Vanilla lattes, cappuccinos and iced coffees sold under variations of the name “Sugar Free.”

At the center of the controversy is an ingredient millions of Americans consume every day — milk.

Milk naturally contains lactose, a form of sugar. Although McDonald’s uses sugar-free flavored syrups in certain coffee beverages, the plaintiffs argue that eliminating sugar from the syrup does not make the finished drink sugar-free.

Indeed, McDonald’s own McCafé product description identifies steamed whole milk and sugar-free French Vanilla syrup as ingredients in its Sugar Free French Vanilla Latte.

That distinction matters, particularly to consumers monitoring their total sugar intake rather than simply avoiding added sugar.

Under 21 CFR § 101.60(c), federal rules generally permit a sugar-free claim only when a food contains less than 0.5 grams of sugar per reference amount customarily consumed and per labeled serving.

An 18-gram beverage would contain 36 times that numerical threshold. Whether McDonald’s marketing violates the applicable legal requirements remains for the court to determine.

There is another potentially significant development.

The plaintiffs' attorneys allege McDonald’s began changing certain beverage descriptions from “Sugar Free” to “Reduced Sugar” after similar litigation was filed against Starbucks on October 2, 2026. They contend that some McDonald’s marketing continued using the original terminology.

That alleged timing could become important. If supported by internal records, changes to product descriptions may help establish what the company knew about its advertising and when. A subsequent marketing change, however, does not automatically establish wrongdoing.

The lawsuit also raises a practical consumer-protection question: Should customers be expected to investigate nutritional disclosures elsewhere when the product name itself appears to promise an absence of sugar?

This is especially relevant to people managing diabetes or carefully monitoring carbohydrate consumption, although the complaint's advertising allegations do not establish that any customer suffered a medical injury.

The plaintiffs seek monetary relief and changes to the challenged labeling. Their claims remain unproven, no class has been certified, and McDonald’s has not been found liable.

The case could ultimately turn on whether reasonable consumers understood “sugar-free” to describe only the flavored syrup or the entire beverage they purchased.

For McDonald’s, the difference between those two interpretations may prove considerably more expensive than a cup of coffee.
