Musk vs. OpenAI: Billion-Dollar Trial Ignites Fight Over “Stolen Charity” and Future of AI

The courtroom clash between Elon Musk and Sam Altman is underway and the stakes could reshape the future of artificial intelligence and charitable giving itself.

In a high-drama trial unfolding in California, Musk took the stand in a dark suit and delivered a blunt warning that cut to the core of the case.

"It's actually very simple"

"It's not okay to steal a charity... If it's okay to loot a charity, the entire foundation of charitable giving will be destroyed."

That stark claim sets the tone for a legal battle fueled by billions of dollars, clashing visions, and a bitter fallout between former allies who once helped build OpenAI.

A friendship turned rivalry

What began as a shared mission to develop safe artificial intelligence has spiraled into a courtroom war. Musk and Altman, once collaborators, now accuse each other of betraying that original purpose.

An OpenAI lawyer fired back, accusing Musk of acting out of competitive self-interest.

"We're here because Mr Musk didn't get his way at OpenAI"

"Because he's a competitor, Mr Musk will do anything to attack OpenAI."

The courtroom tension is not just personal. It reflects a deeper conflict over power, control, and the direction of one of the world’s most transformative technologies.

Billions at stake

Musk is seeking billions of dollars in what his legal team calls "wrongful gains." He wants that money redirected to OpenAI’s non-profit arm and is pushing for a dramatic shake-up, including the removal of Altman.

His lawyer, Steven Molo, made a sweeping claim to the jury.

"Without Elon Musk, there would be no OpenAI. Pure and simple."

Musk had donated $38m (£28m) when OpenAI operated as a non-profit. The turning point came in 2018, when the company created a commercial arm years before launching ChatGPT and igniting the global AI boom.

Molo did not mince words in court, alleging that Altman and co-founder Greg Brockman "stole a charity."

The control battle

OpenAI’s legal team paints a very different picture. They argue Musk tried to dominate the company and even pushed to merge it with Tesla.

"The other founders refused to turn the keys of artificial intelligence over to one person"

"When they refused to let OpenAI be absorbed" Musk "took his marbles and went home."

The accusation goes further.

"Since he couldn't control OpenAI, he left it. He left it, he thought, for dead."

OpenAI insists Musk’s outrage is not about principles, but about lost influence and rising competition.

AI race fuels the conflict

At the heart of the dispute is the explosive race toward artificial general intelligence, often referred to as Artificial General Intelligence.

OpenAI claims Musk is trying to slow down a rival as the industry accelerates. His own venture, xAI, launched in 2023 with its chatbot Grok, has trailed competitors since entering the market after ChatGPT’s breakout success.

OpenAI also argues Musk understood and accepted the company’s shift toward a commercial model and only walked away after failing to become CEO.

Courtroom warnings and public drama

The trial has already spilled beyond the courtroom.

Judge Yvonne Gonzalez Rogers warned both sides to avoid influencing proceedings through public statements, especially on social media.

The warning came after Musk posted on X, calling Altman "Scam Altman."

The judge declined to impose a gag order but made her expectations clear.

"Try to control your propensity to use social media to make things worse outside this courtroom."

Altman and Brockman agreed to follow the same guidance.

What comes next

Altman is expected to testify, setting up another pivotal moment in a trial already packed with high-stakes claims and sharp accusations.

A verdict is expected in late May, with potential consequences that could ripple far beyond Silicon Valley.

At issue is not just money or control, but a deeper question that could redefine the tech world.
