New Jersey Takes Kalshi Sports Betting Battle To Supreme Court As Federal Appeals Courts Split

New Jersey has taken its high-stakes battle against Kalshi to the U.S. Supreme Court, asking the justices to decide whether prediction markets can escape state gambling laws by classifying sports wagers as federally regulated financial contracts.

The petition places one of the fastest-growing—and most legally contested—forms of online betting before the nation’s highest court. Its outcome could determine whether states retain their traditional authority to license and police sports gambling or whether the Commodity Futures Trading Commission has exclusive control over these markets.

Kalshi allows customers to buy and sell contracts tied to the outcome of future events, including elections, economic developments, weather and sporting contests. The company maintains that its sports-related products are “event contracts” traded on a federally regulated designated contract market—not conventional bets placed with a sportsbook.

New Jersey sees little practical difference.

State officials contend that Kalshi and similar platforms offer sports betting without obtaining state gaming licenses or complying with consumer protections, including age restrictions and state-specific prohibitions. New Jersey, for example, restricts wagering on collegiate teams based in the state and college games played within its borders.

Attorney General Jennifer Davenport said prediction-market companies have no right to offer sports wagers while disregarding state law, emphasizing that states across the political spectrum have challenged the industry’s operations.

New Jersey is asking the Supreme Court to overturn an April 2026 decision from the U.S. Court of Appeals for the Third Circuit, which affirmed a preliminary injunction preventing state regulators from enforcing New Jersey gambling laws against Kalshi.

In a 2-1 ruling, the Third Circuit concluded that Kalshi had demonstrated a reasonable likelihood of proving that its sports contracts qualify as “swaps” under the Commodity Exchange Act. Because Kalshi operates a CFTC-licensed designated contract market, the majority found that federal law likely preempts New Jersey’s competing regulatory requirements.

The ruling was not a final judgment on the merits. It nevertheless gave Kalshi significant protection from state enforcement and established a powerful precedent for treating sports-event contracts as federally regulated derivatives.

Judge Jane Roth dissented, warning that gambling has historically fallen within state police powers and arguing that federal commodities legislation should not be interpreted to displace that authority.

The legal landscape shifted dramatically on August 28 when the Ninth Circuit reached the opposite conclusion in a case involving Nevada. That court ruled that Kalshi could not block Nevada regulators from requiring a gaming license.

Writing for the unanimous panel, Judge Ryan Nelson characterized the contracts as having the defining features of sports betting and rejected the proposition that the CFTC had become a national gambling regulator through the Commodity Exchange Act.

The conflicting appellate decisions create the kind of clear circuit split that often attracts Supreme Court intervention. Kalshi may now operate under materially different legal rules depending on where its customers live.

The dispute reaches far beyond whether Kalshi’s products are called bets, trades, contracts or swaps.

If the Supreme Court adopts Kalshi’s position, federally registered prediction markets could potentially offer sports contracts nationwide without navigating the state-by-state licensing system governing conventional sportsbooks. States warn that such a ruling could undermine restrictions protecting minors, preserving game integrity and limiting prohibited categories of wagers.

Kalshi and the CFTC counter that Congress created a uniform federal framework for contracts traded on designated markets and granted the federal agency exclusive jurisdiction over them.

The Supreme Court is not required to accept New Jersey’s petition. If review is granted, however, the resulting decision could redraw the boundary between federal financial regulation and state gambling authority—and permanently reshape America’s multibillion-dollar sports betting industry.
