Inside the Hursh Courtroom Showdown

OKLAHOMA CITY — A lawyer with no formal role in the case stood up from the gallery Monday morning and stopped a major homeowners insurance hearing cold.

Hannah Whitten, attorney for Billy and Lacy Hursh, had just started reading from a recent deposition when Paige Masters objected. Masters represents State Farm in a separate Comanche County case and hadn't entered an appearance in this one. Her warning: the transcript wasn't final, and State Farm had 30 days under a protective order in West v. State Farm, another Oklahoma case, to designate parts of it confidential.

Oklahoma County District Judge Amy Palumbo paused the arguments and made Masters identify herself on the record. "I'm not in the habit of just letting people pop up from the gallery and weigh in," Palumbo said. Then she let Masters finish her point.

That moment says plenty. State Farm, the largest insurer in Oklahoma, faces nearly 1,000 individual lawsuits accusing it of systematically reducing or denying roof damage payouts after severe weather. Hursh is described as a centerpiece. Yet a State Farm lawyer from a case in a different county was policing what could be read aloud in this one. The company's confidentiality fights don't stay in one courtroom.

About 35 minutes in, Palumbo cited the need to balance public access against existing protective orders, cleared the media and spectators, and continued behind closed doors. The hearing paused after the better part of three hours and reconvened that afternoon. By the end, she had granted the plaintiffs' confidentiality motion in part and ordered 11 State Farm documents de-designated.

The confidential label comes off, which means the documents can be cited in open court and public pleadings. Whitten had asked for 24 documents and to strike what plaintiffs call a "blanket" designation covering 800,000 pages of State Farm's discovery. Eleven is less than half. Palumbo took the other 13 under advisement. Still, it's a crack in the wall.

The public hasn't seen the 11 yet. "I anticipate the public will see them when we are able to rely on them and use them in pleadings, which could be any day now," Whitten told reporters. She expects to file a motion relying on some of the documents so the public can "see for themselves how State Farm handles these claims."

Discovery was the day's other fight. Palumbo said, with clear frustration, that nearly a year has passed since she first ordered State Farm to produce certain categories of records, including extensive claim files. She asked why full productions, complete privilege logs and clear redactions still haven't arrived. Then she put the company on notice: she'll raise it every time the parties appear, because State Farm's "inability or unwillingness to comply" has it in "very dangerous sanction territory."

Plaintiffs' representatives say they've received heavily redacted "white-box" files, email chains that have to be pieced together from multiple exhibits, and executive files missing metadata. They call it a stall tactic. Whitten said the delay playbook starts the moment a policyholder files a claim. "It's kind of become pervasive inside the insurance industry," she said.

State Farm's answer is volume. Lance Leffel, an attorney at GableGotwals representing the company, said compliance means reviewing tens of thousands of claim files, more than 800,000 pages, to protect personal information of policyholders and third parties under state and federal privacy laws. "There's no ill will," Leffel said. "This idea that this is all being done for delay is just not true."

Here's the tension. Those same 800,000 pages are State Farm's explanation for slow production, and they're the pages plaintiffs say were stamped confidential wholesale. Shielding a policyholder's personal details is legitimate. Shielding a company's internal documents is something else, and Palumbo just decided at least 11 of them shouldn't wear the label.

State Farm said in a statement that it evaluates each claim on its facts and coverage, and has paid more than $1 billion to Oklahoma customers for wind and hail damage from 2024 through 2025. It called the narrative pushed by "billboard attorneys" misleading. But a billion-dollar total doesn't answer the question at the heart of Hursh - whether individual claims were shortchanged. The documents may.

Trial is set for Dec. 7, 2026.
