In a legal swing, Philadelphia Indemnity Insurance Co. has teed off against Franjo Construction Corp. and Irwin Interiors System Inc., dragging them into a Pennsylvania state court battle over a whopping $280,000 in damages inflicted on a Pittsburgh golf club. The insurer contends that the construction companies are squarely on the hook for reimbursing the coverage payout following a pipe burst fiasco, adding a layer of complexity to the unfolding legal drama.

Philadelphia Indemnity is pointing fingers at Franjo and Irwin, accusing them of negligence in a complaint filed Wednesday. The insurer asserts that the contractors overlooked the critical installation of thermal insulation, a misstep that could have averted the significant water losses suffered by the Fox Chapel Golf Club. The complaint outlines the negligence claim, contending that the omission directly led to extensive damage to both real and business personal property, invoking a clause in the Pittsburgh club's commercial property insurance policy.

"As a direct and proximate result of [the defendants'] negligence, plaintiff Fox Chapel Golf sustained extensive damage to its real and business personal property," Philadelphia Indemnity asserted. "Pursuant to the aforementioned insurance policy, Philadelphia Insurance is subrogated to Fox Chapel Golf for this loss.

Project Timeline Unravels in the Court's Spotlight

The legal tussle traces its roots back to 2013 when Fox Chapel enlisted Franjo Construction as the general contractor for a substantial addition and renovation project. Franjo, in turn, subcontracted with Irwin, assigning them tasks crucial to the project's success, including the installation of thermal insulation. Fast forward to the project's completion in early 2016, only to have the bar and dining areas drenched in disaster in January 2022.

The calamity struck when a sprinkler line in the ceiling froze and burst, unleashing a deluge of water and potential legal repercussions. An inspection in April 2022 revealed a perplexing detail - the area around the ruptured pipe was "completely devoid of any insulation," leaving it exposed to the unforgiving embrace of cold air, Philadelphia Indemnity revealed.

Philadelphia Indemnity didn't merely watch from the sidelines. The insurer stepped into the fray, cutting a check of approximately $280,000 to Fox Chapel for its losses. Now, armed with a subrogated claim, Philadelphia Indemnity is seeking retribution, aiming to hold Franjo and Irwin accountable for the financial fallout. The insurer contends that the contractors were negligent in adhering to construction documents, failed in training or supervising their employees, and overlooked the fundamental need for insulation to shield the vulnerable sprinkler line.

As the legal match unfolds, representatives for the involved parties remained tight-lipped, declining immediate comment on the gripping courtroom spectacle.

Philadelphia Indemnity is marshaling its legal forces with representation from Jonathan C. Beech of Poerio & Walter Inc., while counsel information for the defendants is not immediately available.

The case, Philadelphia Indemnity Insurance Co. v. Franjo Construction Corp. et al., case number GD-24-000384, finds its stage in the Court of Common Pleas for Allegheny County, Pennsylvania.
