Popeyes Sues Former Iowa Franchisee for Operating ‘Unauthorized’ Restaurants

USA HERALD - Popeyes Louisiana Kitchen, Inc. has filed a sweeping federal lawsuit against five Iowa restaurants and their operator, Asif Poonja, accusing them of unlawfully continuing to use the Popeyes name, marks, and trade dress after their franchise agreements were terminated.

The complaint, filed in the U.S. District Court for the Southern District of Florida on September 5, 2025, names as defendants five LLCs tied to Poonja—Jam Equities of Coralville, Jam Equities of E Ave (Cedar Rapids), Jam Equities of Waterloo, Jam Equities of Dubuque, and Jam Equities of Merle Hay (Des Moines)

Popeyes claims each location “failed to comply with Popeyes’ standards and specifications with regard to food safety and brand standards” and, despite repeated notices dating back to 2024, continued operations without authorization

Evidence from the Complaint

The 23-page complaint details a paper trail of default notices and termination letters:

  • Coralville: Failed multiple inspections and received an August 29, 2025 termination notice after prior warnings in May and June 2025
  • Merle Hay (Des Moines): Terminated August 29, 2025, after years of non-compliance dating back to October 2024
  • Dubuque: Received default notices in March, April, and June 2025, then failed inspection on August 1, 2025
  • Waterloo: Found in repeated violation as of June and August 2025
  • Cedar Rapids (E Ave.): Default notices as early as October 2024, termination issued August 29, 2025

Despite these terminations, the complaint alleges defendants “continue to hold themselves out to the public as owning and operating genuine and authorized POPEYES® Restaurants by continuing to display and/or use the Marks”

Popeyes also accuses the defendants of failing to return proprietary Operating Standards Manuals (OPS Manuals), confidential documents that govern everything from food preparation to health and sanitation standards

Legal Claims

Popeyes asserts Lanham Act violations (Sections 32 and 43(a)), common law trademark infringementunfair competition, and breach of contract across all five franchise agreements

The company further points to personal guaranties signed by Poonja, making him personally liable for each franchise’s obligations

According to the complaint, the ongoing use of Popeyes branding creates a “likelihood of consumer confusion and deception,” misleading customers into believing the Iowa locations remain legitimate Popeyes restaurants

Relief Sought

Popeyes demands both injunctive and monetary relief:

  • A court order barring the defendants from using any Popeyes trademarks, logos, or trade dress.
  • Authority for Popeyes to enter and alter the restaurants to remove all branding.
  • Return of confidential manuals and operating documents.
  • Treble damages, punitive damages, attorneys’ fees, and costs under the Lanham Act and contract provisions
  • A two-year ban on defendants owning or operating any chicken restaurant within a 10-mile radius of the affected locations

What’s Next

The defendants must file a response within 21 days of service of the summons. If they fail to respond, Popeyes could move for a default judgment enforcing the relief requests in the complaint.

Given Popeyes’ demand for injunctive relief, an early hearing on preliminary injunction could be pivotal. If granted, it may immediately force the Iowa restaurants to strip signage and cease using Popeyes’ branding while litigation continues.

Settlement remains possible, but Popeyes’ filing signals an aggressive strategy to protect its brand footprint.
