Educators Fired Over Charlie Kirk Remarks Take Their Free Speech Fight to Court

USA HERALD - Three educators who lost their jobs in the heated aftermath of Charlie Kirk’s assassination are suing, alleging their First Amendment rights were trampled. The lawsuits, filed in September 2025, come from:

  • Matthew Kargol, a former high school teacher in Oskaloosa, Iowa.
  • Lauren Vaughn, a teacher’s assistant in Spartanburg, South Carolina.
  • An unnamed employee of an Indiana public university.

All three argue that their dismissals stemmed from constitutionally protected speech made on personal social media accounts, not official school platforms.

Kirk, 31, co-founder of Turning Point USA and a close ally of President Donald Trump, was gunned down on Sept. 10, 2025 at Utah Valley University. Prosecutors allege Tyler Robinson, 24, fired a single rifle shot from a rooftop, ending Kirk’s life in front of a crowd.

The killing shocked the nation and intensified partisan debates over political violence. Conservative commentators and elected officials demanded accountability—not just for Robinson, but also for anyone who appeared to celebrate Kirk’s death online.

School districts and universities quickly moved to terminate employees whose posts drew outrage. The lawsuits argue those firings were illegal retaliation, others contend that it doesn’t matter because in most cases an employer can fire an employee at-will.

What the Employees Said

  • Matthew Kargol (Iowa): On Sept. 11, posted “1 Nazi down” on his personal Facebook page. He was suspended the same day and terminated by unanimous school board vote on Sept. 17, according to theDes Moines Register. His lawsuit calls the remark “rhetorical hyperbole” that “did not threaten any person, did not incite imminent unlawful action and was not directed at any member of the school community.”
  • Lauren Vaughn (South Carolina): Fired Sept. 15 from River Ridge Elementary School. Her attorney, Jack Cohoon, insists her social media posts “were nothing that she should have been terminated for.”
  • Indiana University Employee: Details remain sparse, but court filings confirm an individual was terminated for similar online commentary referencing Kirk.

What’s Next

Each lawsuit will proceed through its respective state courts, with likely motions to dismiss from school districts claiming that public employees’ speech can be restricted when it undermines public trust. Expect:

  • Preliminary hearings on motions in October–November 2025.
  • Discovery battles over whether online posts caused “disruption” sufficient to justify firings.
  • Potential appeals to federal courts, raising broader First Amendment questions about social media speech by public employees.

The outcome could establish precedent for how far schools and public employers can go in disciplining staff for online commentary, particularly in moments of national crisis.
