Sometimes the most dramatic disputes aren't fought at sea, but in the pages of an insurance policy long after the ship has already been boarded. That's the story now closing its final chapter, as three insurers have reached a settlement with Chevron over whether their marine cargo and war risk policies should have covered nearly $52 million in crude oil seized by the Iranian military — a seizure carried out in apparent retaliation for U.S. economic sanctions.

The Deal That Ended the Dispute

Zurich American Insurance Co., Liberty Mutual Insurance Co. and Great American Insurance Co. filed an unopposed motion to vacate all filings in the case, confirming a settlement had been reached with Chevron. Notably absent from the filing were any specifics about the terms, and representatives for the parties stayed tight-lipped Wednesday, declining to respond to requests for comment.

The Argument Insurers Tried to Make

Back in a May 2024 complaint, the trio of insurers argued the seizure fell outside their coverage entirely, reasoning that the U.S. and Iran weren't technically at war when the incident occurred — a legal distinction they hoped would let them sidestep the payout. Just this past April, the insurers pushed for summary judgment, framing Chevron's loss as stemming from the confiscation of the oil itself rather than the seizure of the vessel carrying it, an argument akin to saying a stolen cargo container doesn't count the same as a stolen truck.

How the Oil Ended Up in Iranian Hands

The saga traces back to 2023, when Chevron chartered a vessel called the Advantage Sweet to haul 735,000 barrels of crude oil from Kuwait to Houston, according to court filings. But the voyage took an unexpected turn when Iran's Navy boarded the ship while it passed through the Gulf of Oman, seizing control of it entirely. The vessel remained in Iranian custody until March 2024, when a court order permitted the Iranian government to transfer the oil onto one of its own vessels. The Advantage Sweet itself wasn't released for another four months after that.

Chevron's Fight for Reimbursement

Following the seizure, Chevron filed a formal claim seeking nearly $52 million from its primary insurers, hoping to recover the financial damage tied to the lost crude. The insurers, however, denied coverage in May 2024 — and on that very same day, turned around and sued Chevron directly, essentially beating the oil giant to the courthouse.

Chevron Fires Back

Chevron didn't sit quietly. The company countered with claims of its own, seeking declaratory relief while alleging breach of contract and bad faith — not just against its primary insurers, but also against its excess insurers, including Royal and Sun Alliance Insurance Ltd. and various Lloyd's underwriters, widening the legal battlefield considerably.

The Legal Teams Who Fought It Out

Representing Zurich, Liberty Mutual and Great American were Shari L. Klevens and Alanna Clair of Dentons, Jonathan Gross of Mound Cotton Wollan & Greengrass LLP, and Joseph Grasso of Grasso Moeller LLC.

Chevron's defense was handled by Anthony P. Tatum, Michael S. Gehrt, Mikaela Whitman, Kelsey D. Haines, Jenny Yi and Dylan M. Bensinger of McGuireWoods LLP.

Royal and Sun, along with the Lloyd's underwriters, were represented by James P. Koelzer and David Ktshozyan of Clyde & Co. LLP.

What began with an oil tanker boarded in international waters ultimately settled the way many high-stakes commercial disputes do — not with a dramatic verdict, but with a quiet agreement that leaves the details behind closed doors.
