Numbers on a tax assessment can feel abstract until they land squarely on a property owner's bottom line — and that's precisely the tension at the heart of a recent ruling out of Nebraska. State officials have sided with a local assessor's valuation of a 48-unit apartment complex, brushing aside the owner's push for a lower number based on the building's condition and the shifting rental market.

The Ruling, Line by Line

In an order released Tuesday, the Nebraska Tax Equalization and Review Commission determined that the four-building complex had been correctly valued at $1.8 million for tax year 2025. Lexington Apartment Homes LLC, the property's owner, had hoped to knock that figure down to $1.15 million — but the commission found the arguments presented simply didn't carry enough weight to justify the reduction. The owner had pointed to a prior case, noting the Dawson County Board of Equalization had granted a similar reduction the previous year under nearly identical circumstances.

The Owner's Case for a Lower Number

Lexington Apartment Homes built its argument on a familiar trio of grievances: the building's poor physical condition, rising property insurance costs squeezing operating income, and a broker's price opinion pegging the property's value at $1.22 million — a figure meant to serve as independent backup for the requested reduction.

Where the Evidence Fell Short

But evidence, much like a building's foundation, needs to be solid enough to hold weight — and the commission found cracks in the owner's case. Regarding the broker's opinion, the commission noted it didn't specify whether the assessment had been completed by a licensed appraiser following uniform standards of professional appraisal practice — a missing credential that undercut its persuasive power.

The income approach appraisal fared no better. According to the commission, Lexington Apartments failed to provide supporting evidence for the property's claimed expenses, leaving the financial argument standing on assumptions rather than documentation.

A Firm Line Drawn

The commission's decision, dated Sept. 4, ultimately reaffirmed the original $1.8 million valuation, leaving the property owner without the reduction it sought and reinforcing just how much weight proper documentation carries in Nebraska's property tax disputes. In a case built on competing appraisals and dollar figures, it was ultimately the paperwork — not the pitch — that decided the outcome.
