Starbucks Accuses Union of Trademark Infringement Over Pro-Palestine Tweets

Starbucks Corp. finds itself in a legal battle with the union representing its baristas, accusing the union of misusing its name and logos. This dispute has led to calls for a boycott against the coffee giant, triggered by union tweets expressing support for Palestine. The union, in turn, claims that Starbucks has falsely accused it of supporting terrorism as part of its ongoing anti-union campaign.

In its Iowa federal court complaint, Starbucks alleges that Workers United is unlawfully using the name "Starbucks Workers United" and has incorporated Starbucks' trademarks without authorization into the union's logos. Starbucks asserts that this has caused confusion among customers who may believe the coffee company endorses the statements made by the union. One such statement on X (formerly known as Twitter) expressed solidarity with Palestine following an attack by Hamas militants on Israel.

Starbucks argues that the similarity between the union's marks and its own trademarks is likely to mislead customers, conveying a false affiliation, endorsement, or sponsorship with Starbucks. This confusion has already resulted in harm, including public backlash against Starbucks.

For instance, after the Hamas-led events in Israel on October 7, Starbucks claims that the union retweeted a post showing a bulldozer allegedly tearing down a fence on the Israel-Gaza border with the message "Solidarity with Palestine." Due to the union's use of the Starbucks name, customers incorrectly attributed this post to Starbucks despite the company's efforts to clarify the situation.

Starbucks has cited several pro-Palestine posts retweeted by the Iowa City Starbucks Workers United, including one promoting a protest in Chicago. These actions have resulted in hundreds of complaints from customers and the public, wrongly blaming Starbucks for supporting Hamas.

This legal dispute includes claims of trademark dilution, trademark infringement, and copyright infringement. Starbucks seeks injunctive relief to prevent further infringement, damages, attorney fees, and other remedies.

Starbucks Accuses Union of Trademark Infringement Over Pro-Palestine Tweets

Starbucks alleges that its employees have faced threats, and its stores have been vandalized as a result of the confusion created by the union's tweets. Moreover, there have been calls for a boycott of the coffee chain.

In a countermove, Workers United filed its own complaint against Starbucks in Pennsylvania federal court. The union is seeking a declaratory judgment to continue using the name and logo "Starbucks Workers United." Workers United argues that Starbucks has defamed the union through public statements suggesting that it supports "terrorism, hate, and violence."

The union contends that Starbucks' statements are a deliberate attempt to damage its reputation and its standing with workers and the public. Workers United pointed out that various unions have integrated the employer's name into their titles, similar to "Half Price Books Workers United," "Amazon Labor Union," and "Southwest Airline Pilots Association."

Starbucks Workers United was formed in 2021 after Starbucks employees in Buffalo, New York, began unionizing with support from Workers United. The union's logo features the words "Starbucks Workers United" encircling a clenched fist holding a cup.

According to Law360's Starbucks Unionization Tracker, Starbucks employees have initiated unionization efforts at more than 500 locations across the country. The company has responded by allegedly surveilling, firing, and disciplining workers supporting unionization. The union has filed over 650 unfair labor practice charges against Starbucks regarding its union response.

While this legal battle unfolds, Workers United maintains that its identity is distinct from Starbucks and has no interest in creating confusion. As for the "Solidarity with Palestine" tweet, the union claimed it was not authorized by union leadership and was deleted within 40 minutes. Starbucks' demands for the union to cease using its name and intellectual property did not, according to Workers United, include evidence of public confusion.

Starbucks has made public statements implying that Workers United supports violence and terrorism, leading to harm to the union's reputation. The lawsuit brought by the union seeks a declaratory judgment of noninfringement of trademarks and compensation, including punitive damages.

In a statement, Starbucks reiterated that some customers had wrongly linked the union's statements to the company. Starbucks has denied allegations of anti-union behavior and emphasized its commitment to good faith bargaining.

Representatives for Starbucks Workers United and Workers United's legal counsel did not respond immediately to requests for comment.

This dispute reflects a broader trend of companies accusing unions of trademark infringement, further highlighting the complexity of such conflicts.
