Supreme Court Blocked Trump From Firing a Federal Reserve Governor

Federal Reserve Governor Lisa Cook takes the oath of office in May 2022. On June 29, 2026, the Supreme Court voted 5-4 to block President Trump's attempt to remove her from the position.

No president had ever fired a Federal Reserve governor in the institution's 111-year history. When Trump did it last August, citing unproven fraud allegations that produced no criminal charges, every court that reviewed the move blocked it. On Monday, the Supreme Court voted 5 to 4: the firing cannot stand. For now. 

Chief Justice John Roberts wrote the majority opinion. Roberts, appointed by President George W. Bush, and Justice Brett Kavanaugh, appointed by President Trump, joined the court's three Democratic-appointed justices: Elena Kagan, Sonia Sotomayor and Ketanji Brown Jackson.

 

 

What the Court Actually Decided

Monday's ruling is not the final word on the case. The Supreme Court left intact a lower court order that had reinstated Cook to her post, allowing her to remain at the Federal Reserve while her legal challenge plays out in the courts below.

The core legal question, whether the president had valid grounds to remove her, has not been decided. The ruling came after nearly ten months of litigation in which lower courts had blocked the firing at every stage.

 

A Ten-Month Legal Battle

The chain of events began on August 15, 2025, when Bill Pulte, director of the Federal Housing Finance Agency, publicly accused Cook of mortgage fraud. Ten days later, on August 25, Trump formally removed Cook from her post "for cause," citing those allegations.

Cook's legal team fought back immediately. In a federal court hearing on August 29, her attorneys described the process as "an obvious smear campaign" built on "vague, unsubstantiated allegations."

Federal District Judge Jia Cobb issued a preliminary injunction on September 9, blocking the firing and ordering Cook reinstated. The judge found that Trump had not validly removed Cook "for cause" under federal law.

The administration appealed. The D.C. Circuit Court of Appeals rejected the emergency appeal on September 15. On September 18, the Trump administration petitioned the Supreme Court directly.

Oral arguments were held in January 2026. Former U.S. Solicitor General Paul Clement argued for Cook, current Solicitor General D. John Sauer argued for the administration. The court issued its 5-4 ruling on June 29.

 

The Firing and the Accusation

The accusations against Cook centered on her mortgage applications from June and July 2021, before she joined the Federal Reserve Board. The administration alleged that she claimed both a home in Ann Arbor, Michigan, and a home in Atlanta, Georgia, as her primary residence at the same time. A criminal referral on the matter was sent to Attorney General Pam Bondi.

Public records from Fulton County, Georgia, show that Cook did not apply for the homestead tax exemptions that Georgia law makes available to property owners who declare a home as their primary residence. Applying for those exemptions is the standard way to formally claim that tax benefit. She has not been charged with any crime.

 

The Law at the Center of the Case

The Federal Reserve Act, gives the president authority to remove a Federal Reserve governor "for cause." But actually, the law does not define what "for cause" means.

That undefined phrase is the center of the legal dispute. Courts have interpreted it to require a legitimate factual basis: misconduct, neglect of duty, or incapacity. But the precise boundaries are not clear. Whether an unproven allegation of mortgage fraud, denied by the accused and unaccompanied by criminal charges, meets that standard is the question the courts below still need to answer.

The Supreme Court noted that the Federal Reserve is "a uniquely structured, quasi-private entity." That description signals the justices may apply a different legal standard to the Fed than to other independent agencies when the full case is eventually decided.

 

Who Is Lisa Cook

Cook was nominated by President Biden and confirmed by the Senate in May 2022. She is the first Black woman to serve as a governor of the Federal Reserve Board.

With Trump's August 2025 action, she became the first Federal Reserve governor ever fired by a president in the institution's 111-year history. Every court that has reviewed that firing since then has blocked it.

 

What Comes Next

The case, Trump v. Cook, returns to the lower courts. The legal battle over what "for cause" means under the 1913 law will continue, and no court has yet issued a final ruling on whether Trump's attempt to fire Cook was lawful.

For now, she remains in her post.
