Supreme Court Again Rejects Trump Bid to Undo $5 Million E. Jean Carroll Verdict

The justices denied rehearing without comment, leaving the 2023 civil judgment intact after Carroll received more than $5.6 million.

The U.S. Supreme Court on Monday denied President Donald Trump’s bid to reopen his appeal of a $5 million civil judgment won by writer E. Jean Carroll. The unsigned order listed the case among several rehearing petitions denied and gave no reason.

The action leaves intact a 2023 Manhattan jury verdict that found Trump liable for sexually abusing Carroll and defaming her. It does not decide a separate $83.3 million defamation judgment now before the court.

Rehearing Denial Ends Trump’s Latest Bid in the $5 Million Case

In docket No. 25-573, Trump asked the justices to reverse their June 29 refusal to review the case. His lawyers wanted the court to hear the appeal or wait for a related immunity case.

The rehearing petition argued that two official White House statements from 2019 were an “indispensable component” of Carroll’s 2023 trial. Trump’s lawyers said an immunity ruling on those statements could affect the evidence shown to the jury.

The original appeal focused on trial evidence. It challenged testimony from two other women who accused Trump of sexual misconduct and the admission of the “Access Hollywood” recording. The 2nd U.S. Circuit Court of Appeals upheld the judgment in December 2024 and denied full-court rehearing in June 2025.

The case was civil, not criminal, so Trump was not convicted. Jurors found sexual abuse, but not rape under the definition on the verdict form, using the civil “more likely than not” standard. They awarded about $2 million for sexual abuse and about $3 million for defamation. Trump has denied wrongdoing.

After the Supreme Court first rejected review, a federal court released the money from a court-held account. USA Herald previously covered Trump’s bid to block that release while rehearing was pending.

Carroll received more than $5.6 million, including interest, in July. “We are pleased to report that she has received the damages payment,” said her attorney, Roberta Kaplan.

Separate $83.3 Million Carroll Appeal Remains Pending

A second case covers statements Trump made in 2019 during his first term. A different Manhattan jury awarded Carroll $83.3 million in January 2024, including $65 million in punitive damages.

The 2nd Circuit upheld that award in September 2025. Trump and the Justice Department argue that his 2019 statements fell within his federal duties. They seek legal protection under presidential immunity and the Westfall Act.

That dispute is docketed as No. 26-141 and remains separate from Monday’s rehearing denial. Carroll’s response in the larger case is due Aug. 31.

At least four justices must vote to hear the second appeal, but the court has not set a conference date. Monday’s order ends this rehearing request in the $5 million case. The larger appeal remains unresolved.
