Andrew Tate, 39, and his brother Tristan, 38, will be freed from the federal detention facility in Miami where they have been held since their arrest on July 18. According to a source for USA Herald familiar with the proceedings, the ruling is expected to come after Judge Louis weights down the brothers' history of compliance with judicial supervision in Romania against the government's warnings that they posed a flight risk.

Thursday's hearing, the second attempt to resolve the question after an August 13 hearing was postponed at the defense's request, turned on competing pictures of the brothers' reliability. Defense attorney Howard Srebnick told the court the Tates had "regularly appeared in court in Romania," where they remain on pre-trial release in a separate case, and argued their extraordinary public profile made disappearance impractical rather than easy — a level of visibility, he said, that cuts against the government's flight-risk theory rather than for it.

Prosecutors with the Miami US Attorney's Office had pushed back hard. In filings, they argued that international extradition cases carry a strong presumption in favor of detention, and pointed to British authorities' allegations that the brothers strangled victims during forcible rapes as evidence they could pose a danger to the community. They also cited Romanian authorities' claims that the Tates sought to influence witness statements while under judicial supervision there — including allegations they threatened to release private information about an alleged victim and offered a bribe. The defense disputed that account, telling the court the women in question wanted to speak on the brothers' behalf and that the Tates had simply helped coordinate their travel to Bucharest and paid for their legal representation.

In the end, the conditions Judge Louis imposes will largely track what the defense had proposed at the outset: surrender of both brothers' passports, submission to location monitoring, and a bond sized to reflect the government's flight-risk concerns without denying release outright. It is a comparatively rare outcome in international extradition proceedings, where courts require defendants to show "special circumstances" beyond the ordinary bail factors before release is granted at all.

The expected ruling will not resolve, and would never intende to resolve, the underlying question of the brothers' guilt or innocence. Andrew and Tristan Tate face a combined 59 charges in the United Kingdom — including rape, sexual assault, and human trafficking for sexual exploitation — tied to allegations from at least seven women between 2010 and 2017. Both deny all wrongdoing, and neither has been convicted of any offense in any country.

What the ruling might change is where the brothers wait. Rather than a Miami jail cell, they will then await the next stage of the case under home confinement–style conditions in Florida while Britain assembles the paperwork that will determine whether they are sent back across the Atlantic at all. The United Kingdom has until September 16 to submit its full extradition request to the US State Department — the filing that will trigger the actual extradition hearing, a separate and more consequential proceeding in which a magistrate will examine whether the treaty's evidentiary threshold has been met.
