During the hearing in Newport News, Robinson ruled that the charges against Parker could not legally stand under Virginia’s current laws. According to local television reports, the judge said prosecutors’ arguments relied on “legal theories” that are not specifically addressed in state statutes.The dismissal came after Parker’s defense team filed a motion to strike the charges. Once the ruling was announced, Parker reportedly became emotional and broke down in tears inside the courtroom.The charges alleged Parker failed to act appropriately after several warnings that the child may have brought a firearm to school on Jan. 6, 2023. Teacher's Family Reacts to Decision in Virginia School Shooting

Following the dismissal of charges, members of Zwerner’s family issued statements expressing relief that the legal process surrounding the criminal case had concluded. Karen Piere, identified as Zwerner’s aunt, said the family hoped the tragedy would inspire changes within the American education system. “

As devastating as this shooting was, may it bring change to the education system in our country so that violent children are not placed in a general education classroom,” the family statement said.

The statement also called for accountability among school administrators if similar incidents occur in the future. Meanwhile, Parker declined to speak publicly after leaving court.

Civil Lawsuit Implications

Attorneys representing Zwerner said the judge’s ruling could affect arguments previously raised by the City of Newport News regarding insurance liability in the civil litigation.

Lawyers Diane Toscano, Kevin Biniazan, and Jeffrey Breit released a statement arguing that city officials could no longer point to alleged criminal conduct as grounds to deny insurance coverage connected to the lawsuit. The attorneys said the dismissal removes “one of the many obstacles” placed in Zwerner’s path to justice.

Legal experts say the case may still influence future debates about accountability standards for educators and school administrators during potential safety threats involving students.
