Ripple Lawsuit Outcome: Blockchain Firm Eyes American Market Post Landmark Ruling

Ripple Lawsuit

The Ripple lawsuit, a prominent legal battle in the blockchain world, has taken a new turn. Ripple, the San Francisco-based blockchain startup, has expressed optimism that the American financial sector will embrace its XRP cryptocurrency for cross-border transactions. This optimism comes in the wake of a groundbreaking ruling that affirmed XRP is not in itself a security.

Stu Alderoty, Ripple’s General Counsel, anticipates dialogues with U.S. financial firms to begin in the third quarter regarding their On-Demand Liquidity (ODL) product, which employs XRP for money transfers. This anticipation builds on the Ripple lawsuit's watershed decision where a New York judge stated XRP itself is “not necessarily a security on its face.”

Ripple's Bitter-Sweet Victory Over the SEC

The Ripple lawsuit had been raging for the past three years, pitting Ripple against the U.S. Securities and Exchange Commission (SEC). At the heart of the contention were accusations that Ripple and its executives conducted an illicit offering of XRP worth $1.3 billion. Ripple vehemently refuted these allegations, arguing that XRP shares more similarities with commodities than securities.

The lawsuit's blowback significantly impacted Ripple's business, prompting the U.S. money transfer giant, MoneyGram, to terminate its partnership with Ripple in March 2021. Simultaneously, Tetragon, a U.K.-based investor, opted to sell its Ripple stake back to the company after a failed legal bid to cash out its investment.

Ripple's Future Prospects and the Return of American Banks

Alderoty expressed belief that the Ripple lawsuit's ruling will encourage U.S. banks to reconsider Ripple's ODL product. Ripple’s blockchain-based business, which offers a Swift-like messaging service for banks, could provide institutions relief from exorbitant cross-border transaction fees.

"Hopefully this quarter will stimulate many discussions in the United States with customers, and hopefully some of these conversations will translate into real business," Alderoty stated optimistically.

Currently, most of Ripple's business is sourced outside of the U.S. Nonetheless, Ripple boasts a robust workforce of over 750 employees globally, with approximately half based within the U.S.

The Versatility of XRP and its "Bridge" Function

XRP, the cryptocurrency at the core of the Ripple lawsuit, serves as Ripple's primary tool for moving money across borders. Currently ranked as the fifth-largest cryptocurrency with a market capitalization of $37.8 billion, XRP operates as a “bridge” currency, enabling rapid money transfers between different fiat currencies.

However, the Ripple lawsuit did not result in a complete victory for Ripple. The judge stated that while XRP was not a security, certain sales of the token did classify as securities transactions. Around $728.9 million of sales of XRP to institutional clients were deemed securities, with the judge citing an expectation of profit and common enterprise.

Alderoty recognized the ruling as not entirely in Ripple's favor, expressing the company's intentions to review the decision's business implications. "We'll study the judge’s decision, we’ll consider our clients' needs and the market dynamics to see how we can operate within the framework established by the judge," he concluded.
