Trial of Former Philly Union Leader

Jury selection is poised to kick off on Wednesday in the long-awaited second act of the government's relentless pursuit of justice, implicating the once-mighty former Philadelphia union honcho, John "Johnny Doc" Dougherty. This upcoming milestone arrives after a labyrinth of legal acrobatics, including a slew of delays and attorney switches, all orchestrated within the lengthy shadow of the COVID-19 pandemic.

Trial of Former Philly Union Leader : The Accused

Dougherty, who once held sway as the influential business manager of International Brotherhood of Electrical Workers Local 98, and his co-defendant Brian Burrows, the former president of the local, will soon find themselves in the hot seat. They stand accused of orchestrating a grand conspiracy to pocket the union's hard-earned cash and assets. This saga unfolds nearly two years after the initial trial concluded with Dougherty's conviction for bribing a Philadelphia city councilman.

A Battle in Jury Selection

As the gavel drops on the trial, both the prosecution and defense are meticulously poring over prospective jurors' affiliations and opinions. Their proposed voir dire questions, submitted earlier this week, delve deep into the potential jurors' union connections, work stoppages, or business involvements, making the selection process as intriguing as the courtroom showdown itself.

"The jury pool, even if not overtly biased, is bound to be a crucible of contrasting opinions on unions and the defendant," noted Jonathan K. Osborne, an observer of the case. "Both sides must grapple with this duality, as people can be fervently pro- or anti-union."

Dougherty's Former Allies in the Crosshairs

After a 2019 indictment, the case was dissected into multiple parts for trial. In the first installment, Dougherty and Philadelphia Councilman Bobby Henon were found guilty in 2021 of bribery and theft of honest services. This conviction was rooted in the $70,000-a-year, no-show job Dougherty offered Henon in exchange for council votes favoring the union.

Now, the focus shifts to allegations of Dougherty, Burrows, and their cohorts embezzling funds from the union's coffers, using union-issued credit cards for personal splurges, paying union-affiliated contractors for personal projects, and commandeering union resources for their own enjoyment. Some of Dougherty and Burrows' co-conspirators have already caved and pleaded guilty, fueling speculation that they may testify against the duo, aiming to shift blame and reduce their own sentences.

"The defense's uphill battle is to scrutinize the witnesses' motivations and credibility," Osborne explained. "A cooperating witness has every reason to embellish or deflect blame to secure a lighter sentence."

Trial of Former Philly Union Leader : A Legal Odyssey in Two Acts

The second phase of this legal drama was perpetually buffeted by the tumultuous seas of the COVID-19 pandemic. It weathered a "cooling-off period" post-first trial to clear potential jurors' minds and navigated the maze of Dougherty's attorney changes.

Initially, Dougherty had a legal dream team from Ballard Spahr LLP, who represented him in the first trial. However, they parted ways afterward. In November, due to financial constraints, Dougherty was assigned court-appointed counsel. Then, in May, he reinstated private attorney Gregory Pagano, who recently sought another delay to sift through a mountain of evidence but was denied.

Last week, Dougherty's legal team reiterated the trial's challenges. They submitted a request to limit evidence strictly to acts directly linked to the charges against Dougherty, aiming to prevent juror overwhelm and prejudice stemming from allegations of corruption.

Amidst these legal quagmires, Burrows and Dougherty disagreed over delaying the case further, with Burrows anxious to resolve the charges after his bid to dismiss the case for lack of a speedy trial failed in September.

As we embark on this legal rollercoaster, the defendants' counsel and the prosecution remain tight-lipped and elusive, leaving the suspense in the air as the trial of the former Philly union leader barrels ahead.
